An Act to provide for the Registrat ion of

Legally Qualified Medical Practi t ioners. [12th
October, 1855.]
WH E R E A S qualification of Medical Wi tnesses on Coroners ' I n q u e s t s and
i t is expedient to a m e n d t h e law re la t ing to t h e
o ther Inqu i r i e s Be i t therefore enacted by H i s Excel lency the Governor
for any o ther m e m b e r to preside for t h e t ime being.
of N e w South W a l e s w i t h t h e advice and consent of t h e Legis la t ive
Counci l thereof as follows :—
1. A n y person who shall prove to t h e satisfaction of t h e N e w
Sou th W a l e s Medica l Board or a q u o r u m thereof t h a t h e has passed

t h r o u g h a regu la r course of medical s tudy of not less t h a n t h r ee years ' du ra t ion in a School of Medicine and t h a t he has received after due examina t ion from t h e Univers i ty of Sydney or from some Univers i ty College or o ther body duly recognized for t h a t purpose in t h e coun t ry to which such Univers i ty College or o ther body may be long a d iploma degree or license en t i t l ing h im to prac t ice medic ine in t h a t coun t ry

shall be deemed to be a legally qualified Medica l P rac t i t ioner wi th in
t h e m e a n i n g of t he Acts passed in t h e second a n d n in th years of t he

re ign of H e r p resen t Majesty and n u m b e r e d respectively twenty- two and twelve and shall be en t i t l ed to a certificate as such from the said Board .

2. A q u o r u m of t h e Board u n d e r t h e reci ted Ac t shal l for t h e
fu tu re consist of no t less t h a n th ree member s thereof a n d in case of
t he absence of t h e P res iden t of t h e said Board it shall be compe ten t

3. I t shall be lawful for the said Board (or a quorum thereof) to examine any person who may present himself for examination or any witness who may be produced before them and to take a solemn declaration from such person or witness and if any person shall wil­

fully knowingly and corruptly make any false statement upon such
examination or in such declaration or shall utter or attempt to utter
or put off as true before the said Board (or a quorum thereof) any false
forged or counterfeit diploma degree license certificate or other docu­ ment or writing such person shall be guilty of a misdemeanor and being thereof duly convicted shall be liable to imprisonment with or without hard labor for any period not exceeding three years.
4. I f any person fraudulently or by false representations obtain any certificate as a duly qualified Medical Practitioner under the pro­ visions of this Act or the said recited Acts or shall forge alter or counterfeit any such certificate or shall utter or use any such forged
certificate knowing the same respectively to have been forged or shall falsely advertise or publish himself as having obtained such certificate
every person guilty of any or either of the said offences shall be deemed guilty of a misdemeanor and being thereof duly convicted shall be liable to imprisonment with or without hard labor for any period not exceeding three years.

5. This Act shall so far as is consistent with the contents and

subject matter thereof be taken as part of and construed with the said
recited Acts.

6. This Act may be cited as " The Medical Practitioner's Act

of 1855."
