HEREAS it is desirable to amend the law relating to Licensed

W Surveyors-Be it therefore Enacted by the Governor of the Province of South Australia, with the advice and consent of the

Legislative Council and House of Assembly of the said province, in this present Parliament assembled, as follows:

1. This Act may be cited for all purposes as " The Licensed Short title.

2. " The Licensed Surveyors Act, 1839," being Act No. 13 of Repeal.

1859, is hereby repealed: Provided that such repeal shall not affect

any licence granted under the said repealed Act, or the validity of

any survey heretofore made thereunder.

Three of the members of the Board shall be members of the South Australian Institute of Surveyors, Incorporated, and shall from time to time be nominated by such Institute as members of the Board prior to being appointed by the Governor. The members so nominated shall retire from officc on the thirty-first day of December in every gear, but shall be eligible for re-appointment on being again nominatcd as aforesaid.

Quorum.

5, At any meeting of the Board three members shall form a quorum. The members of the Board for the time being may act notwithstanding any vacancy in their body, and should they at any time be less than three the quorum for a meeting shall be the num- ber ~f members then in office.

6, Before granting a certificate to any person, in the Form A in

the Second Schedule hereto, the Board shall examine such person

as to his qualifications as a surveyor, and may require testimonials respecting his character, and the Board may refuse a certificate to any person if they shall deem him not properly qualified, or if they shall not be satisfied as to his character.

7, The Board shall hold an examination twice a year, in the months of March and September rcspecti~ely, and also at any times that they may fix by rcgulation, and shall give at least one montli's notice in the Government Gazette of every examination.

8, Every person applying to be examined shall pay to the Board, previous to his examination, a fee of Five Pounds Five Shillings, and shonld he fail to pass his examination to the satisfactiou of the Board, he shall, previous to any future examination, pay to the Board a fee of Two Pounds Two Shillings for each such examination.

15. In the event of a lessee objecting under the preceding Re-e~mey

16. The Board may from time to time make, alter, and repeal Regulations.

18, In the absence of any special agreement, any licensed sur-

veyor shall be entitled to charge fiom the party employing him, the

fees provided for in the Fourth Schedule hercto.
