526 Qitrzit5Iitxtl ANNO VICESIMO QUINTO ELIZABETHAE SECUNDAE REGINAE An Act to authorize The Honourable Jack Lawrence Kelly, a Judge of the Supreme Court of Queensland, to accept take and perform the duties of the office of Judge Advocate General of the Australian Army [ASSENTED TO 5TH OCTOBER, 19761 Preamble. Whereas The Honourable Jack Lawrence Kelly is a Judge of the Supreme Court of Queensland: And whereas The Honourable Jack Lawrence Kelly aforesaid has been put forward as a suitable appointee to the office of Judge Advocate General of the Australian Army: And whereas The Honourable Jack Lawrence Kelly aforesaid is desirous of accepting appointment to the office of Judge Advocate General of the Australian Army: And whereas the acceptance taking or performance by The Honourable Jack Lawrence Kelly aforesaid of the duties of the office of Judge Advocate General aforesaid would be deemed in law an avoidance of his office of Judge of the Supreme Court of Queensland:

The Honourable Jack Lawrence Kelly Enabling Act 527 BE IT THEREFORE ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title . This Act may be cited as The Honourable Jack Lawrence Kelly Enabling Act 1976. 2. Authority to accept take and perform office of Judge Advocate General . For as long as The Honourable Jack Lawrence Kelly, a Judge of the Supreme Court of Queensland, does not accept any remuneration or emolument attaching to the office of Judge Advocate General of the Australian Army he is hereby authorized- (a) to accept take and perform the duties of that office in addition to his holding his commission as a Judge of the Supreme Court of Queensland; and (b) to receive payment of his reasonable travelling and accommodation expenses incurred in performing the duties of that office. 3. Section 12 SupremeCourt Act does not apply. Section 12 of the Supreme Court Act 1867-1975 does not apply to The Honourable Jack Lawrence Kelly in respect of his accepting taking or performing the duties of the office of Judge Advocate General of the Australian Army pursuant to the authority conferred by this Act.
