I, the Minister for Planning, make the following local environmental plan under the

Environmental Planning and Assessment Act 1979.

Environmental Planning and Assessment Act 1979

1      Name of Plan

This Plan is The Hills Local Environmental Plan 2012 (Amendment No 19).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to certain land at Kellyville, being:

(a)

301 Samantha Riley Drive, comprising Lots 101 and 103, DP 1122070, and

(b)

part of drainage reserves fronting Samantha Riley Drive, comprising part of Lot 1, DP 1067762 and part of Lot 1, DP 1028391.

4      Maps

The maps adopted by The Hills Local Environmental Plan 2012 are amended or replaced, as the case requires, by the maps approved by the Minister on the making of this Plan.

5      Amendment of The Hills Local Environmental Plan 2012

Schedule 1 Additional permitted uses

Insert after clause 1:

1A

Use of certain land at Samantha Riley Drive, Kellyville

(1)

This clause applies to certain land at Kellyville, being:

(a)

301 Samantha Riley Drive, comprising Lots 101 and 103, DP 1122070, and

(b)

part of drainage reserves fronting Samantha Riley Drive, comprising part of Lot 1, DP 1067762 and part of Lot 1, DP 1028391,

shown as “Item 3” on the Additional Permitted Uses Map.

(2)

Development for the purposes of shops is permitted with consent.

(3)

Development consent under subclause (2) may only be granted if the

retail floor space on the site is no more than 1,900m2.
