AN ACT to amend section three of The Fremantle

Gas and Coke Company's Act, 1886-1961.

[Assented to 11th May, 1978.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

1. (1) This Act may be cited as The Fremantle and citation.

Section 3	2. Section 3 of the principal Act is amended
amended.

(a)	by inserting after the section designation "3." the subsection designation "(1)"; and
(b)	by adding a further subsection as follows

(2) Notwithstanding the provisions of subsection (1) of this section, the Governor on the recommendation of the Minister may from time to time declare that this Act, so far as it relates to land situate South of the Swan River, shall extend to such places as are comprised within a boundary designated by reference to the said circle of five miles but so determined along the lines of streets or otherwise as to vary not more than one half of one kilometre on either side of the said circle, and the limits of this Act shall thereupon be varied accordingly, but no such recommenda- tion shall be made without prior consultation by the Minister with the Company and the State Energy Commission. .
