Alteration of other rules of organisation.

  1. On 7 September 2017 The Civil Air Operations Officers’ Association of Australia lodged with the Fair Work Commission a notice and declaration setting out particulars of alterations to its rules.

  1. The particulars set out alterations to Rules 22, 24, 26, 34 and 46.

  1. The alterations create the office of Alternate Divisional Delegate for the Melbourne Centre Division and Brisbane Centre Division on National Executive.

  1. Although the office of Alternate Divisional Delegate has been created, the role of the office is to mirror the existing Divisional Delegate office. The Divisional Delegate and Alternate Divisional Delegate for each Division are both entitled to attend National Executive meetings, but it is not necessary that both attend. If they are both in attendance, they will not both count for the purposes of quorum, but will instead only count for one person and only one of them will exercise the Division’s voting rights. The alterations also make minor technical amendments.

  1. On the information contained in the notice, I am satisfied the alterations have been made under the rules of the organisation.

  1. In my opinion, the alterations comply with and are not contrary to the Fair Work (Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise agreements, and are not otherwise contrary to law. I certify accordingly under subsection 159(1) of the Fair Work (Registered Organisations) Act 2009.
