[1] On 27 March 2014 the The Breweries and Bottleyards Employees' Industrial Union of Workers of Western Australia (the organisation) lodged with the Fair Work Commission a notice and declaration setting out particulars of alterations to the rules of the organisation.
[2] The particulars set out alterations to alterations to rules 10.D, 10.E and 35 of the rules of the organisation. These alterations were made in part to remedy an omission in the alterations made for the purpose of complying with provisions of the Fair Work (Registered
Organisations) Amendment Act 2012 (the Amendment Act) – [2014] FWCD 24. In the
decision, I advised that the omission of the requirement for training covering each of the officers’ financial duties occurring within 6 months after the person begins to hold office would need to be remedied by the organisation as expeditiously as possible in order to ensure full compliance with the provisions of the Amendment Act.
[3] On the information contained in the notice, I am satisfied the alterations have been made under the rules of the organisation.
[4] On 22 July 2014, Ronald James Murphy, Secretary of the organisation gave consent, under subsection 159(2) of the Fair Work (Registered Organisations) Act 2009, for the Delegate to make various amendments to the alterations for the purpose of correcting typographical, clerical or formal errors. Accordingly the following corrections have been made:
In proposed rule 10.E(a) the insertion of “)” after the word “Act” and before
“2009”.
[5] In my opinion, the alterations comply with and are not contrary to the Fair Work (Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise
agreements, and are not otherwise contrary to law. I certify accordingly under subsection
159(1) of the Fair Work (Registered Organisations) Act 2009.
