Proposed protected action ballot by employees of OneSteel Trading Pty Ltd T/A OneSteel Sheet & Coil.

[1] This is an application for a protected action ballot of members of the The Australian Workers’ Union (AWU) employed by OneSteel Trading Pty Ltd T/A OneSteel Sheet & Coil (OneSteel).

[2] This application was filed by the AWU 28 October 2011.

[3] The Human Resources Manager Merchandising, Ms Karena Suttor, of OneSteel advised my chambers by email dated 2 November 2011 that the company does not oppose the order (that is, the company did not challenge that the AWU had been and was genuinely trying to reach an agreement).

[4] In the circumstances I have decided to determine the matter on the papers without holding a hearing.

[5] I am satisfied that the requirements in s.443(1) of the Act have been met and that, accordingly, an order must be made. An order based on the draft order provided by the AWU has issued in conjunction with this decision.
