FAIR WORK AUSTRALIA

DECISION

Fair Work Act 2009
s.437—Protected action

The Australian Workers’ Union
v
Holcim Australia Ltd T/A Humes
(B2011/4054)

COMMISSIONER RYAN

MELBOURNE, 9 DECEMBER 2011

Proposed protected action ballot by employees of Holcim (Australia) Pty Ltd T/A Humes.

[1] This is an application for a protected action ballot of members of The Australian Workers’ Union (AWU) employed by Holcim Australia Ltd T/A Humes (Humes).

[2] The application was filed by the AWU on 7 December 2011.

[3] On 8 December 2011 Mr McCallum-Gaul, Manager of Humes advised my Associate by email that the company will not seek to oppose the granting of the protected action ballot order.

[4] In the circumstances I have decided to determine the matter on the papers as I am satisfied it is not necessary to hold a hearing.

[5] I am satisfied that the requirements in s.443(1) of the Act have been met and that, accordingly, an order must be made. An order based on the draft order provided by the AWU has been issued in conjunction with this decision.
