Proposed protected action ballot by employees of CSR Ltd t/as CSR Bricks & Roofing.

[1] This is an application for a protected action ballot of members of The Australian Workers’ Union (AWU) employed by CSR Bricks and Roofing (CSR).

[2] This application was filed by the AWU on 1 May 2012.

[3] My Associate emailed Mr Neill Roos, Springvale Operations Manager of CSR, on 1 May 2012 asking CSR to indicate whether it would be objecting to the granting of this application. Mr Roos responded on the morning of 2 May 2012 advising that Mr Shepherd of the Australian Industry Group would respond directly on his behalf.

[4] Mr Shepherd did respond by email on 2 May 2012 advising that CSR does not oppose the application and would not object to the order being granted on the papers.

[5] In the circumstances I have decided to determine the matter on the papers without holding a hearing.

[6] I am satisfied that the requirements in s.443(1) of the Act have been met and that, accordingly, an order must be made. An order based on the draft order provided by the AWU has issued in conjunction with this decision.
