DECISION

Fair Work (Registered Organisations) Act 2009
s.159—Alteration of other rules of organisation
The Australian Workers’ Union
(R2014/302)
MR ENRIGHT MELBOURNE, 19 DECEMBER 2014
Alteration of other rules of organisation.

[1]        On 3 December 2014, The Australian Workers’ Union lodged with the Fair Work

Commission a notice and declaration setting out particulars of alterations to the rules of The

Australian Workers’ Union.

[2]        The particulars set out alterations to Rule 33(7)(n) of the rules of The Australian

Workers’ Union, which would have the effect of reducing the number of full time Vice

Presidents in the Victorian Branch of The Australian Workers’ Union from three to two.

[3]        On 15 December 2014, The Australian Workers’ Union lodged with the Fair Work

Commission a declaration that a full time Vice President in the Victorian Branch had resigned

on 11 November 2014.

[4]        On the information contained in the notice and further declaration, I am satisfied the

alterations have been made under the rules of the organisation.

[5]        In my opinion, the alterations comply with and are not contrary to the Fair Work

(Registered Organisations) Act 2009 (the RO Act), the Fair Work Act 2009, modern awards

and enterprise agreements, and are not otherwise contrary to law. I certify accordingly under

subsection 159(1) of the RO Act.
