Alteration of other rules of organisation.

  1. On 7 July 2020, The Australian Workers' Union (AWU) lodged with the Fair Work Commission a notice and declaration setting out particulars of alterations to the rules of the AWU.

  1. The particulars set out alterations to rule 33 of the rules of the AWU - The Branches and Divisions of the Union. More specifically, the alterations amend sub-rule 33(7) and have the following effects:

  • The abolition of one office of Branch Executive Committee Member in the South Australian Branch; and

  • The abolition of one full time office of, and the creation of a new honorary office of, Branch Vice President in the Victorian Branch.

  1. The material filed with the application indicates that both of the abolished offices are currently vacant. I also note the effect of existing sub-rule 61(3) which provides that any rule alterations abolishing or creating a new office shall not take effect until the next scheduled election in respect of which the rule alterations were made.

  1. On the information contained in the notice, I am satisfied the alterations have been made under the rules of the organisation.

  1. In my opinion, the alterations comply with and are not contrary to the Fair Work (Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise agreements, and are not otherwise contrary to law. I certify accordingly under subsection 159(1) of the Fair Work (Registered Organisations) Act 2009.
