The applicant seeks special leave to appeal from a decision of the Court of Appeal of the Supreme Court of Victoria (Ferguson CJ, Sifris and Kennedy JJA) to affirm the decision of the primary judge (Garde J).
The Environment Protection Act 1970 (Vic) having been repealed the application does not raise an issue of sufficient public importance to warrant the grant of special leave to appeal. Special leave should be refused.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
