Work Health and Safety Act 2011 - Application for external review.

[1] Following a Conference held at the Fair Work Commission (the Commission) on 4 April 2014 and having considered the submissions of the Applicant and the consent of the Respondent, the Commission Orders that:

1. The operation of improvement notices EVE223480 0001NTOI and 22348NTO1 be stayed until further order of the Fair Work Commission.

[2] The following directions are made:

1. The matters are listed for a 1 day Hearing on 12 May 2014.

2. The Commission grants the parties leave to be represented by solicitors and counsel at the hearing of this matter, pursuant to s 596 of the Fair Work Act 2009 (Cth).

3. By 17 April 2014, the Applicant lodge with the Commission and serve on the Respondent outlines of evidence of any witnesses to be called by the applicant, any documents of which the applicant intends to rely, and an outline of submissions.

4. By 5 May 2014, the Respondent lodge with the Commission and serve on the Applicant outlines of evidence of any witnesses to be called by the respondent, any documents of which the respondent intends to rely, and an outline of submissions.

5. By 8 May 2014, the Applicant lodge with the Commission and serve on the Respondent any outlines of evidence and any documents it wishes to rely upon by way of reply, and any submissions of reply.
