Order relating to instruments covering new employer and transferring employees.
[1] The Australian Industry Group, in its own capacity as a likely new employer, has lodged an application seeking an order relating to instruments covering transferring employees.
[2] The effect of what is sought in the application made pursuant to the Fair Work Act 2009 is that where there is a transfer of business from the Department of Industry and Science to The Australian Industry Group then the One Innovation Enterprise Agreement 2011 does not, and will not, cover:
(a) The Australian Industry Group;
(b) 14 transferring employees; and
(c) any non-transferring employees of The Australian Industry Group.
[3] The application and the submissions described the background to the making of the application and the grounds in support of the proposed order. The application addressed each matter the Commission must take into account in deciding whether to make an order, and attached signed documentation from the relevant employees indicating their support for the application for the proposed order.
[4] The Association of Professional Engineers, Scientists and Managers, Australia submitted it also supports the application.
[5] On a consideration of the matters relied upon in support of the application, I am satisfied it is appropriate to make an order in the terms sought.
