The Ascent Group Collective Agreement 2007.

[1] On 8 March 2011, The Ascent Group Australia Limited (“the applicant”) filed an application to terminate an instrument titled The Ascent Group Collective Agreement 2007. Upon being allocated the file, I was unable to find any such instrument through the usual search facilities and, therefore, requested further information from the applicant about the instrument which was the subject of the application.

[2] Subsequent correspondence, as elaborated in submissions on 17 March 2011, confirmed that The Ascent Group Collective Agreement 2007 had failed to acquire any legal status, and an earlier instrument titled the Challenge Armidale (Business Services) Workplace Agreement 2004 (AG837676) continued to apply. In the circumstances, the applicant’s representative, Mr P Amos, agent, submitted it was his client’s intention to discontinue the application seeking to terminate The Ascent Group Collective Agreement 2007. A notice of discontinuance was subsequently filed on behalf of the applicant. As such, the proceedings are now concluded.
