An Act to ratify a Lease of certain land granted by the Government of Victoria to the Colonial Ammunition Company Limited for the purposes of an Ammunition Factory.
Preamble
WHEREAS in order to enable the Colonial Ammunition Company Limited, a company duly registered in England, to establish and maintain an Ammunition Factory in Victoria, a lease of five acres of land or thereabouts at Cut-Paw-Paw in the county of Bourke has by a lease bearing date the twenty-eighth day of May One thousand eight hundred and eighty-nine been granted by the Governor in Council to the said company:
AND WHEREAS a certified copy of the said lease was presented to both Houses of Parliament on the seventeenth day of September One thousand eight hundred and eighty-nine:
AND WHEREAS such lease was granted and accepted on the express condition that in the event of the Parliament of Victoria not ratifying the granting of the said lease within twelve months from the date thereof, then the said lease shall be absolutely void and of no effect:
AND WHEREAS it is desirable and expedient that the said lease be ratified by Parliament:
BE IT THEREFORE ENACTED by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):
1.Short title
This Act may for all purposes be cited as The Ammunition Factory Act 1889.
2.Lease ratified and confirmed
Notwithstanding anything contained in any Act relating to lands of the Crown, the lease granted by the Governor in Council to the Colonial Ammunition Company Limited and bearing date the twenty-eighth day of May One thousand eight hundred and eighty-nine, together with all the rights powers privileges and easements thereby created and conferred, is hereby ratified and confirmed, and it shall be lawful for the Governor in Council to carry out and give effect to the same.
3.Factory to be erected and delivery of cartridges commenced within twelve months
The condition of the lease providing that the said company will within twelve months from the date of such lease erect upon the land demised an ammunition factory with all the necessary machinery and appliances shall be held to be complied with if the factory as aforesaid be so erected within twelve months after the passing of this Act; and the condition providing that the lessees and their successors will commence to deliver ammunition cartridges within twelve months from the date of such lease shall be held to be complied with if such delivery be commenced within twelve months after the passing of this Act.
