Alteration of other rules of organisation.
[1] On 9 May 2019 the TFGA Industrial Association lodged with the Fair Work Commission a notice and declaration setting out particulars of alterations to its rules.
[2] The particulars set out alterations to;
Rule 27.2 – Executive Committee – Election.
[3] The alteration to Rule 27.2 will enable candidates for election to place on the TFGA Industrial Association’s webpage, a statement and photograph that states the name and address at which the nominee mainly carries on their particular industry. This statement will not exceed 100 words and shall indicate the candidate’s service to that industry, service to the community, and special interests and qualifications of any type.
[4] On the information contained in the notice, I am satisfied the alterations have been made under the rules of the organisation.
[5] On 4 June 2019, 14 June 2019 and 20 June 2019, Felicity Richards, President of the TFGA Industrial Association, gave consent, under subsection 159(2) of the Fair Work (Registered Organisations) Act 2009, for the Delegate to make various amendments to the alterations for the purposes of correcting typographical, clerical or formal errors. Accordingly, the following corrections have been made:
● In proposed rule 27.2(i)(a), the word ‘Service’ has been decapitalised and a ‘;’ has been added at the end of the provision.
● In proposed rule 27.2(i)(b), the word ‘Service’ has been decapitalised and a ‘;’ followed by the word ‘and’ has been added to the end of the provision.
● In proposed rule 27.2(i)(c), the word ‘Special’ has been decapitalised.
[6] In my opinion, the alterations comply with and are not contrary to the Fair Work (Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise agreements, and are not otherwise contrary to law. I certify accordingly under subsection 159(1) of the Fair Work (Registered Organisations) Act 2009.
