[ASSENTED TO 20TH DECEMBER, 1946.] B E it enacted by the King's Most Excellent Majesty, . by and with the advice and consent of the I..4egis- lative Assembly of Queenslandin Parliament assembled, and by the authority of the same, as follows;- 1. This Act may be cited as " The Texas Memorial Short title. Hall and Other Lands Ac~ of 1946." 2. In this Act- Interpre- tation. (a) The term "trustees" means in respect of the Texas Memorial Hall the persons and each of them who, under the provisions of *" The Real Property Acts, 1861 to 1942," are, at the date of the passing of this Act, registered as the proprietors of the estate in fee-simple of the land described in Schedule 1. to this Act, as trustees; and (b) The term " The Texas Memorial Hall " means the land described in Schedule I. to this Act. 3. (1.) Notwithstanding any other Act or law the Texas land described in Schedule 1. to this Act (which land is ~: ~:: fed publicly known as "The Texas Memorial Hall ") shallin the Council of -- - - - - - - - - ~ - - - - - -- - -- - -- - --- --- --- --- --- --fueShlooof * 25 V. No. 5, be and is hereby divested from the trustees and trans· ferred to and vested in the Council of the Shire of Inglewood as proprietor of the estate in fee-simple therein freed and discharged from any trusts in respect thereof. (2.) All other property and assets of any kind whatsoever vested in the trustees for or for the purposes of the trusts for which the trustees held the Texas Memorial Hall shall be and are hereby divested from the trustees and transferred to and vested in the Council of the Shire of Inglewood freed and discharged from any trusts in respect thereof. Every person who has the possession or control of any property or assets hereinbefore in this subsection mentioned shall, and may, without authority other than this Act, do and execute all such acts, matters and things as may be necessary to secure to the Council of the Shire of Inglewood all such property and assets, together with all and every the right, title, estate, and interest therein. (3.) The receipt by the Shire Clerk or other authorised officer of the Council of the Shire of Inglewood of such property and assets shall be a good and sufficient discharge, and the trustees shall not thereafter be liable or accountable therefor or bound to see to the application or appropriation thereof. (4.) All liabilities and obligations of the trustees in respect of the Texas Memorial Hall (other than the liabilities and obligations imposed by the trusts upon and subject to which the Texas Memorial Hall was held at the passing of this Act) shall devolve and be imposed upon the Council of the Shire of Inglewood. Southport 4. (1.) Notwithstanding any other Act or law the ~: ~~~ in the lands described in Schedule H. to this Act shall be and Council of are hereby divested from the Council of the Town of ~~ ~ l~ : ~ ~ f Southport as trustee and transferred to and vested in the Council of the Town of Southport as proprietor of the estate in fee-simple therein freed and discharged from any trusts in respect thereof, but subject never- theless to the existing registered lease registered as number A394798 in the office of the Registrar of Titles at Brisbane.
1946. LOCAL AUTHORITIES. Texas Memorial Hall, Etc., Act. 421 (2.) All other property and assets of any kind whatsoever vested in the Council of the Town of South- port as trustee for or for the purposes of the trusts for which the said Council held the said land shall be and are hereby divested from the Council of the Town of Southport as trustee and transferred to and vested in the Council of the Town of Southport freed and discharged from the trusts in respect thereof. Every person who has the possession or control of any property or assets hereinbefore in this subsection mentioned shall, and may, without authority other than this Act, do and execute all such acts, matters and things as may be necessary to secure to the Council of the Town of Southport all such property and assets, together with all and every the right, title, estate, and interest therein. (3.) The receipt by the Town Clerk or other authorised officer of the Council of the Town of South- port of such property and assets shall be a good and sufficient discharge, and the Council of the Town of Southport as trustee shall not thereafter be liable or accountable therefor or bound to see to the application or appropriation thereof. (4.) All liabilities and obligations of the Council of the Town of Southport as trustee in respect of the said lands (other than the liabilities and obligations imposed by the trusts upon and subject to which the said lands were held at the passing of this Act) shall devolve and be imposed upon the Council of the Town of Southport. 5. The Registrar of Titles shall, upon application Title to in that behalf made by or on behalf of the Council~exas. I of the Shire of Inglewood, register the said Council as H:n~ ~~ the registered proprietor of an estate in fee-simple in ~ ou~ port the land described in Schedule I. to this Act free from an s. any trust upon and subject to which the trustees held such land and shall, upon application in that behalf made by or on behalf of the Council of the Town of South- port, register the Council of the Town of Southport as the registered proprietor of an estate in fee-simple in the lands described in Schedule H. to this Act free from any trust upon and subject to which the Council of the Town of Southport held such land, and for that purpose may issue any certificate of title and make such endorsements upon any deed of grant or certificate of title and entries in registers as may be necessary and proper.

All that piece or parcel of land situated in the County of Clive, Parish of Texas, Town of Texas, containing 1 acre, more or less, being allotment 6 of suburban section 31 and being the whole of the land described in Deed of Grant No. 88061, Volume 980, Folio 71. SCHEDULE H. All those pieces or parcels of land situated in the County of Ward, Parish of Gilston, containing 1 acre 3 roods 22 perches, more or less being subdivisions 35 to 50 of resubdivisions 20, 21, and 22 of sub- division 2 of portion 30 and being the whole of the land described in Certificate of Title No. 346664, Volume 1846, Folio 154. All those pieces or parcels of land situated in the County of Ward, Parish of Gilston, containing 1 acre 2 roods 163/10 perches, more or less, being subdivisions 54 to 67 of resubdivision 22 of subdivision 2 of portion 30 and being the whole of the land described in Certificate of Title No. 391765, Volume 2053, Folio 105. All those pieces or parcels ofland situated in the County of Ward, Parish of Gilston, conta,ining 1 acre 1 rood 146/10 perches, more or less, being subdivisions 22 to 31 and resubdivision 2 of subdivisions 17. 18, 20, 21, 32, 33 and 3t of resubdivisions 20 to 22 of subdivision 2 of portion 30, and being the whole of the land described in Certificate of Title No. 391766, Volume 2053, Folio 106.
