  1. Citation

    These Regulations may be cited as the Territory Wildlife Regulations. (See back note 1)

  2. [Repealed]

  1. Certain animals unprotected in specific areas

    An animal of a species listed in column 1 of Schedule 2 is an unprotected animal while it is in the area described in column 2 of that Schedule in relation to that species.

  2. Snakes may be killed in certain circumstances

    It is a defence to a charge for an offence against section 29(1) of the Act of having killed or injured a snake if -

    (a)the snake was within 100 metres of an occupied building; or

    (b)the defendant proves that he honestly believed that it was necessary to kill or injure the snake to avoid an immediate danger of death or injury to a person or a domestic animal. 

  3. Pests

    An animal of a species listed in Schedule 3 is a pest.

  4. Animals (other than wildlife) which are not prohibited ENTRANTS

    An animal of a species listed in Schedule 4 is not a prohibited entrant.

  5. Possession of wildlife

    For the purposes of section 32 of the Act, a person may have in his possession or under his control a live animal of a species listed in Schedule 5 if the animal was not obtained in contravention of the law of any State or Territory.

  6. Dealing in wildlife

    For the purposes of section 33 of the Act, a person may -

    (a)buy, sell or offer for sale;

    (b)barter or offer to barter; or

    (c)otherwise obtain from or dispose of, or offer to dispose of, to another person,

a live animal of a species listed in Schedule 5 if the animal was not obtained in contravention of the law of any State or Territory.

  1. Consignment of wildlife

    (1)      A person may move or consign from one place to another in the Territory a live animal of a species listed in Schedule 5.

    (2)      A person shall not transport a protected animal in a manner that causes it, or is likely to cause it, injury or suffering.

  2. Capture of wildlife - by permit

    (1)      A permit to catch or restrain a live protected animal -

    (a)shall not be issued to a body corporate;

    (b)is not transferable;

    (c)may be issued for a period not exceeding 12 months, and may be renewed upon its expiry;

    (d)shall specify the name and address of any person authorised by the permit to assist the permit holder in the catching or restraining of a live protected animal;

    (e)shall specify the maximum number of animals which may be caught or restrained in any place or during any period of time;

    (f)may specify conditions as to -

    (i)the devices, substances or means which may be used to catch or restrain a live protected animal; or

    (ii)the manner in which a live protected animal may be identified, whether by tagging, banding or some other method; and

    (g)may require the holder to maintain records, and to allow a conservation officer to inspect those records.

    (2)      An applicant for a permit to catch or restrain shall submit to the Director a statutory declaration stating whether or not the applicant has been convicted of a relevant offence and giving details of any such offence, and an applicant convicted of such an offence shall not be issued with a permit unless the Director considers that it is proper in all the circumstances for the applicant to obtain a permit.

    (3)      In subregulation (2), "relevant offence" means, an offence committed in contravention of the Act or any other offence committed in respect of a protected animal.

  3. Prohibited methods of capture

    A person shall not use a dog or other animal, or use any poison, explosive, firearm, bow, slingshot, spear, net, trap, bird lime or noxious, narcotic, viscid or adhesive substance to catch or restrain a live protected animal unless he is authorized by notice under section 29(3) or permit issued under section 43(1) of the Act.

  4. Capture of wildlife without permit

    A person may without permit catch or restrain an animal of a species listed in Schedule 6 if the animal is not caught or restrained for the purpose of financial gain or to be used as feed for any other animal.

  5. Conditions for keeping and transporting protected animals

    (1)      A person keeping a live protected animal in captivity shall keep it in a cage or enclosure which -

    (a)provides adequate protection from wind, sun, rain and predators;

    (b)is well ventilated;

    (c)is constructed such that it prevents escape;

    (d)allows visual inspection;

    (e)is kept in a clean and sanitary condition; and

    (f)has an adequate supply of water and of suffi-cient and appropriate food.

13A.Articles manuafactured from parts of protected animals

(1) Subject to subregulation (2), a person's acquisition, possession and disposal of a manufactured article containing a part or parts of a protected animal is authorized for the purposes of section 31 of the Act if the manufacture was authorized either by a permit under this Act or by the law of a State or other Territory of the Commonwealth.

(2)      Subregulation (1) applies in relation to an article only if the article or its packaging bears an identification mark or label approved by the Minister and placed on it with the authority of the Commission, or recognized by the Minister as indicating that the article was manufactured in accordance with the law of a State or other Territory of the Commonwealth.

  1. Specially protected animals

    For the purposes of section 9 of the Act, animals of a species listed in Schedule 7 are specially protected animals.

  2. Protected plants

    (1)      Subject to subregulation (2), the species of plants listed in Schedule 8 are protected plants.

    (2)      A plant, being a member of a species specified in Schedule 8, is not a protected plant if it -

    (a)is not a member of a species that occurs naturally in the Territory; or

    (b)being a member of a species that occurs naturally in the Territory -

    (i)was imported into the Territory or was the progeny of a plant imported into the Territory; and

    (ii)is a plant, or is the progeny of a plant, the taking of which was lawful under the Act.

  3. Specially protected plants

    The species of plants listed in Schedule 9 are specially protected plants.

  4. Advance payment in respect of taking of animals and PLANTS

    For the purposes of section 116(2) of the Act, the holder of a permit or licence to take animals or plants may pay, at the time of the issue or grant of the permit or licence, or otherwise at a time in advance of the taking of animals or plants in pursuance of the permit or licence, the amount specified in column 3 of Schedule 10 for each unit of quantity specified opposite in column 2 to be taken of the animal or plant listed opposite in column 1.
