TERRITORY PARKS AND WILDLIFE CONSERVATION (Judbarra / gregory national park Carbon Emissions Reduction project) BY‑LAWS 2022
By‑laws under the Territory Parks and Wildlife Conservation Act 1976
These By-laws may be cited as the
These By-laws commence on the day on which they are notified in the
In these By-laws:
(a) intentionally lighting fires;
(b) slashing;
(c) grading;
(d) fire suppression;
(e) any other form of fire management.
These By-laws apply in relation to:
(a) all the areas of land declared to be a park under section 24(2) of the
Territory Parks and Wildlife Conservation Act 1976 by instrument dated 10 September 2009 and published inGazette G38 on 23 September 2009; and(b) the parcel of land known as Gregory’s Tree Historical Reserve declared to be a reserve under section 24(2) of the
Territory Parks and Wildlife Conservation Act 1976 by instrument dated 10 September 2009 and published inGazette G38 on 23 September 2009.
(1) By-laws 11(1) and (2) and 11A(2) of the
Territory Parks and Wildlife Conservation By-laws 1984 do not apply in relation to use of fire in the Judbarra / Gregory National Park that is:(a) for the purpose of reducing carbon emissions in the Judbarra / Gregory National Park; and
(b) carried out during the period commencing on the commencement of this by-law and ending on 1 January 2045; and
(c) part of an eligible offsets project declared under section 27(2) of the
Carbon Credits (Carbon Farming Initiative) Act 2011 (Cth); and(d) approved by the joint management partners for the Judbarra / Gregory National Park.
(2) By-law 18(1) and (6) of the
Territory Parks and Wildlife Conservation By-laws 1984 does not apply in relation to the disturbance of a natural feature of the Judbarra / Gregory National Park as an ordinary consequence of use of fire that is:(a) for the purpose of reducing carbon emissions in the Judbarra / Gregory National Park; and
(b) carried out during the period commencing on the commencement of this by-law and ending on 1 January 2045; and
(c) part of an eligible offsets project declared under section 27(2) of the
Carbon Credits (Carbon Farming Initiative) Act 2011 (Cth); and(d) approved by the joint management partners for the Judbarra / Gregory National Park.
6 Trade and commerce To avoid doubt, nothing in by-law 5 affects the application of by‑law 13 of the
Territory Parks and Wildlife Conservation By‑laws 1984 to the Judbarra / Gregory National Park.
