REGULATIONS UNDER THE POST AND TELEGRAPH ACT 1901-1950.*

I, THE ADMINISTRATOR of the Government of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Post and Telegraph Act 1901-1950.

Amendments of the Telephone Regulations. 

Commencement.

1. These Regulations shall come into operation on the first day of October, 1956.

Rental within two-mile radius.

2. Regulation 29 of the Telephone Regulations is amended by omitting the table in sub-regulation (1.) and inserting in its stead the following table:—

Subscribers connected to exchanges having access to the following number of subscribers’ lines at the unit fee.

Radius of network or unit fee area.

Annual rental within a two-mile radius of the exchange.

For an exclusive service.

For each subscriber or instrument on a two-party service.

For each subscriber or instrument on a three or more party service.

Business.

3. After regulation 29 of the Telephone Regulations the following regulation is inserted:—

Service connexion fee.

“29a.—(1.) Subject to this regulation, a service connexion fee of Ten pounds is payable in advance by a person—

(a)who applies for permission to rent or use a telephone service; or

(b)who, under regulation 69 of these Regulations, has a telephone service or other apparatus removed to other premises.

“(2.) A service connexion fee is not payable—

(a)in respect of a temporary exchange service provided under regulation 88 of these Regulations; or

(b)if the service can be provided by means of a service that has previously been provided by the Department and does not require the addition, substitution or removal of any line, equipment or apparatus for the purpose of providing the service.”.

4. Regulation 37 of the Telephone Regulations is repealed and the following regulation inserted in its stead:—

Unit fee.

“37. A unit fee of Threepence shall be payable by a subscriber for each effective call originating from the subscriber’s telephone, being a call that the subscriber is entitled to make at the unit fee under regulation 35 or regulation 36 of these Regulations.”.

Extension telephones.

5. Regulation 64 of the Telephone Regulations is amended—

(a) by omitting from sub-paragraph (i) of paragraph (b) the word “and”; and

(b)by adding at the end of that paragraph the following word and sub-paragraph:—

“; and (iii) a service connexion fee of Ten pounds.”.

Transfers.

6. Regulation 72 of the Telephone Regulations is amended by omitting from sub-regulation (2.) the figure and letter “5s.” and inserting in their stead the words “Ten shillings”.

Provision of services not wholly provided by Department.

7. Regulation 91 of the Telephone Regulations is amended—

(a) by omitting from paragraph (f) the word “and” (last occurring); and

(b)by adding at the end thereof the following word and paragraph:—

“; and (h)a service connexion fee of Ten pounds is payable in advance by the applicant if any new line is erected by the Department.”.

Charges for trunk line calls.

8.—(1.) Regulation 138 of the Telephone Regulations is amended by omitting the table in sub-regulation (1.) and inserting in its stead the following table:—

(2.) Regulation 138 of the Telephone Regulations is amended by omitting from the third column of the table in sub-regulation (2.) the figure “2” (wherever occurring) and inserting in its stead the figure “3”.

11. After regulation 147 of the Telephone Regulations the following regulation is inserted:—

Service connexion fee.

“147a. A service connexion fee of Ten pounds is payable in advance by a person applying for a private line (not being a temporary service provided under regulation 152 of these Regulations) provided either in whole or in part by the Department.”.

Application of service connexion fee.

12. The service connexion fee referred to in regulations 29a, 64, 91 and 147a of the Telephone Regulations, as amended by these Regulations, is not payable in any case where, before the commencement of these Regulations—

(a) a person has agreed to rent a service for a fixed term;

(b)the Department has stated that it will provide the service; and

(c) the person has paid in advance the rental for the service required by the Department.
