Part 1                 Preliminary

  1. Name of technical standard [see Note 1]

This technical standard is the Telecommunications Technical Standard (Customer Equipment and Customer Cabling) — ACA TS 102-1998.

  1. Commencement [see Note 1]

This technical standard commences on gazettal.

  1. Definitions

In this technical standard:

Act means the Telecommunications Act 1997.

associated cabling equipment means CE that is mentioned in the Certified Components List.

AUSTEL means the Australian Telecommunications Authority established by the Telecommunications Act 1989.

CC means customer cabling.

CE means customer equipment.

Certified Components List means the list, known as the Certified Components List, that was established by AUSTEL and is published by the ACA on its Internet site.

customer cabling product means CC and associated cabling equipment that, immediately before 1 July 1997, was listed in the Certified Components List.

Labelling Notice means the Telecommunications Labelling (Customer Equipment and Customer Cabling) Notice 2001, as amended from time to time.

TS 100-1997 means the technical standard of that name that:

(a)    was taken to have been made by the ACA; and

(b)    commenced on 1 July 1997.

Note 1   The Certified Components List can be accessed via the ACA Internet site at section 77 of the Telecommunications (Transitional Provisions and Consequential Amendments) Act 1997, certain instruments (including technical standards similar to TS 100-1997) made by AUSTEL before 1 July 1997 have effect on and after that date as if they had been made by the ACA.

Note 3   A number of expressions used in this standard are defined in the Telecommunications Act 1997 (see section 7), including:

·     ACA

·     customer cabling

·     customer equipment.

  1. Purpose of this standard

(1)   Under subsection 376 (1) of the Act, the ACA may, by written instrument, make a technical standard relating to specified CE or specified CC.

(2)   Under subsection 378 (1) of the Act, the ACA must, so far as is practicable, invite and consider representations from interested persons about a proposed standard.

(3)   Because it was not practicable to comply with subsection 378 (1) of the Act, the ACA made Technical Standard (Customer Equipment and Customer Cabling) — ACA TS 101-1998 (the urgent standard), in reliance on its powers under subsection 379 (1) of the Act.

(4)   The urgent standard made provision for specified CE and CC pending the making of a technical standard in accordance with the procedures set out in subsection 378 (1).

(5)   The ACA has had an opportunity to follow those procedures and, in reliance on its powers under subsection 379 (2) of the Act, by this instrument, revokes the urgent standard and makes this standard in its place.

Part 2                 Customer equipment

  1. Application of Part

This Part applies:

(a)    to CE that, immediately before 1 July 1997, was authorised or permitted by an authority or permit of a kind mentioned in section 6; and

(b)    only so far as is necessary or convenient for 1 or more of the matters mentioned in subsection 376 (2) of the Act.

  1. Continuation of general standards for CE

(1) The standard for CE permitted by a permit issued under section 118 of the Telecommunications Act 1989 is the technical standard that, under section 106 of that Act, applied to the CE when the permit came into force.

(2) The standard for CE authorised by an authority of a kind mentioned in section 126 of the Telecommunications Act 1989 is the Telecom Customer Equipment Specifications and the Telecom Regulatory Specifications that applied to the CE when the authority came into force.

(3)   The standard for CE permitted by a permit issued under section 258 of


the Telecommunications Act 1991 is the technical standard that, under section 246 of that Act, applied to the CE when the permit came into force.

Note    A permit issued under section 118, or taken to be issued under section 126, of the Telecommunications Act 1989 is taken, under section 15 of the Telecommunications (Transitional Provisions and Consequential Amendments) Act 1991, to be issued under Division 6 of Part 12 of the Telecommunications Act 1991.

  1. Further standards for certain CE

The CE specified in Schedule 1 must also comply with the following standards:

(a)    the standards mentioned in section 6, as applicable; and

(b)    the standards, if any, for the CE specified in Schedule 1; and

(c)    if clause 5.1.9 of ACA TS 002-1997 applies to the CE — that clause; and

(d)    if the CE has a port for an external headset or handset connection — clause 5.4.1 of ACA TS 001-1997.

  1. Application of AS/NZS 3260

(1)   This section applies to CE that:

(a)    was permitted under a permit made under section 258 of the Telecommunications Act 1991; and

(b)    immediately before 1 July 1997, complied with TS 001-1996.

(2)   However, this section does not apply to CE that complies with section 7.

(3)   The CE must comply, by 1 July 2001, with clauses 6.3.4.1 and 6.5 of Amendment 4 of AS/NZS 3260.

(4)   The requirement mentioned in subsection (3) applies in addition to the requirement mentioned in subsection 6 (3).

Note 1   AS/NZS 3260 is a joint Australian and New Zealand standard published by Standards Australia.

Note 2   AS/NZS 3260 is mentioned in clause 5.1 of ACA TS 001-1997.

  1. Application of Reg Spec 1, TS 001-1990, TS 001-1991 or TS 001-1993

(1)   This section applies to CE in relation to the application of:

(a)    Regulatory Specification No. 1: Electrical Safety Requirements for Customer Premises Equipment; or

(b)    TS 001-1990; or

(c)    TS 001-1991; or

(d)    TS 001-1993.

(2)   However, this section does not apply to CE that complies with section 7.

(3)   CE that, before 1 July 1997, complied with a standard mentioned in subsection (1) must continue to comply, until 1 July 2001, with any of the requirements mentioned in section 6 that applied to the CE before 1 July 1997.

(4)   CE that has not been tested against a standard mentioned in subsection (1) may only be manufactured or imported if a non-compliance label is attached to the CE.

(5)   Subsection (6) is an additional requirement for CE that complied with a standard mentioned in subsection (1) and with a standard mentioned in section 6.

(6)   The CE may only be manufactured or imported on or after 1 July 2001:

(a)    in the case of CE that does not comply with ACA TS 001-1997 — if a non-compliance label is attached to the CE; or

(b)    in the case of CE that complies with ACA TS 001-1997, but not with each applicable standard — if the CE is labelled in accordance with subsection 3.1 (4) of the Labelling Notice; or

(c)    in the case of CE that complies with each applicable standard — if the CE is labelled in accordance with subsection 3.1 (2) of the Labelling Notice.

(7)   A non-compliance label mentioned in this section is the label for a non-complying item, the design of which is set out in the Labelling Notice.

(8)   In this section applicable standard has the meaning given in the Labelling Notice.

Part 3                 Customer cabling product

  1. Application of Part

This Part applies to customer cabling product only so far as is necessary or convenient for 1 or more of the matters mentioned in subsection 376 (2) of the Act.

  1. Customer cabling product

(1)   The standards for customer cabling product are as follows:

(a)    in the case of a product that, when it was first listed in the Certified Components List, was subject to Telecom Customer Equipment Specifications and the Telecom Regulatory Specifications — the specifications that applied to the product at that time;

(b) in the case of a product that, when it was first listed in the Certified Components List, was subject to a technical standard under section 106 of the Telecommunications Act 1989 — the technical standard that applied to the product at that time;

(c)    in the case of a product that, when it was first listed in the Certified Components List, was subject to a technical standard under section 246 of the Telecommunications Act 1991 — the technical standard that applied to the product at that time.

(2)   However cords or cordage must also comply with clause 5.5.2.6 of ACA TS008-1997.

Note 1   A cabling licence issued under section 131, or taken to be issued under section 139, of the Telecommunications Act 1989 is taken, under section 16 of the Telecommunications (Transitional Provisions and Consequential Amendments) Act 1991, to be issued under Division 7 of Part 12 of the Telecommunications Act 1991.

Note 2   The technical standards mentioned in paragraph 11 (1) (b) are Regulatory Specification No. 8: Requirements for Authorised Cabling Products (issue no. 7, 31 July 1989) and TS 008-1990.  The technical standards mentioned in paragraph 11 (1) (c) are TS 008-1991, TS 008-1993, and TS 008-1996.

Note 3   The clause mentioned in subsection 11 (2) is entitled ‘Flammability’.

  1. Revocation

Technical Standard (Customer Equipment and Customer Cabling) — ACA TS 101-1998 is revoked.

Note 1   AS 2772.1 1990, including amendment 1, was treated as being part of clause 5.1.4 of TS 005-1994 from 18 April 1994.  For AMPS CMTS permitted or authorised before that date, AS 2772.1 1990, including amendment 1, is therefore a new requirement.

Note 2   AS 2772.1 1990, including amendment 1, was treated as being part of clause 5.9 of TS 018-1994 from 18 April 1994.  For GSM CMTS manufactured before that date, AS 2772.1 1990, including amendment 1, is therefore a new requirement.

Note 3   AS 2772.1 1990, including amendment 1, was treated as being part of clause 5.1.3 of TS 022-1995 from 4 October 1995.  For Mobilesat terminals manufactured before that date, AS 2772.1 1990, including amendment 1, is therefore a new requirement.
