1. Name of Determination

This Determination is the Telecommunications (Section of Telecommunications Industry) Determination 2001.

1. Commencement

This Determination commences on 24 September 2001.

1. Definitions

In this Determination:

Act means the Telecommunications Act 1997.

Number Portability means the right of a customer receiving a service in relation to a number within particular number ranges to change either the carriage service provider involved in providing the service, the carrier network involved in providing the service, or both, and retain the same telephone number.

Portability Services are supporting services provided to Carriers or Carriage Service Providers in relation to the provision and operation of Number Portability.  These services include:

(i)         port administration services;

(ii)        ported number register database maintenance or provision; and

(iii)the provision of network information services, or intelligent network database services, for call routing.

Note   A number of expressions used in this Determination are defined in the Telecommunications Act 1997, including:

·carrier

·carriage service provider

·listed carriage service

1. Application

This Determination applies to persons providing Portability Services.

1. Specification of Telecommunications Activity

For the purposes of this Determination, the telecommunications activity is the supply of Portability Services.

1. Section of Telecommunications Industry

Persons to whom this Determination applies who carry on, or propose to carry on, the telecommunications activity mentioned in section 5 are determined to constitute the section of the telecommunications industry to be identified as “Portability Service Suppliers”.
