  1. Name of Notice

This Notice is the Telecommunications Labelling (Customer Equipment and Customer Cabling) Amendment Notice 2004 (No. 1).

  1. Commencement

This Notice commences on the date of its notification in the Gazette.

1.8Compliance with replacement standard before expiry of old standard

(1)This section applies in relation to an item mentioned in a category in Part 2 of Schedule 1 if:

(a)a technical standard (the old standard) mentioned in column 3 of that category has an expiry date listed for that standard in column 5; and

(b)another technical standard (the replacement standard) mentioned in column 3 of that category is a replacement standard for the old standard; and

(c)at the time when the item was first manufactured or imported, both the old standard and the replacement standard would, apart from this section, have been applicable standards for the item.

Note 1   Under subsection 1 (3) of Part 1 of Schedule 1, if an expiry date for an old standard has passed, a reference to that standard in Part 2 is to be ignored so that the old standard is no longer applicable for the item.

Note 2   To find out if a technical standard has been replaced by a replacement standard, consult the table of technical standards in Part 1 of Schedule 1.

(2)The supplier of the item must ensure that the item complies with either the old standard or the replacement standard.

(3)If the item complies with the old standard, the supplier may, at any time while the replacement standard is in force, have the item tested against the replacement standard for compliance with that standard.

(4)If the supplier has the item tested against the replacement standard under subsection (3), the supplier must complete a new declaration of conformity showing that the item complies with the replacement standard.

(5)Whichever standard the item complies with is taken to be the applicable standard for the item when it was first manufactured or imported, and the other standard is taken not to be the applicable standard for the item at that time.

(5)A supplier must ensure that an entry for an item on a register for subsection (1) remains on the register for at least 5 years after the item ceases to be supplied in Australia.

4.3Meeting compliance levels

(1)Before an item of a kind mentioned in a category in Part 2 of Schedule 1 is connected to a network or facility, or is supplied, the supplier must:

(a)prepare a description of the item; and

(b)complete and sign a declaration of conformity in relation to the item; and

(c)for each applicable standard for the item — meet the requirements for the compliance level for the applicable standard.

Note 1   These records are to be kept, and made available, in accordance with Part 5.

Note 2   If the item is a modified item, Division 4.3 also applies.

Note 3   The ACA recommends that the requirements of this section be met before a compliance label is applied to the item.

Note 4   See Part 6 for special requirements when there is a change in the applicable standards for an item or in the compliance levels for the standards.

(2)In this section:

requirements, for the compliance level for an applicable standard mentioned in column 3 of a category, means the requirements:

(a)set out in sections 4.4, 4.5 and 4.6; and

(b)explained in the instruction notes for the applicable standard referred to in column 6 of that category.

4.4Compliance level 1

There are no requirements if the compliance level for an applicable standard is compliance level 1.

4.5Compliance level 2

(1)If the compliance level for an applicable standard is compliance level 2, the supplier must have enough of the information mentioned in subsection (2) to show that the item meets the requirements of the applicable standard.

Note   If the information in the compliance record is adequate to demonstrate that the item meets the requirements of an applicable standard, the information may be a single document from the list in subsection (2) or a combination of documents.

(2)The information is:

(a)a test report about one or more requirements of the applicable standard; and

(b)a written statement by a certification body about one or more requirements of the applicable standard; and

(c)if it is impracticable to test the item because of its size, location or nature — a written statement by a competent body certifying that reasonable efforts have been made to avoid a contravention of the applicable standard; and

(d)an approval mentioned in Part 1 of Schedule 7, supported by:

(i)a test report stating that the item meets any requirements in the applicable standard that differ from the requirements in the standard, or the part of the standard, under which the approval was given; or

(ii)a written statement by a certification body to the same effect; or

(iii)if it is impracticable to test the item because of its size, location or nature — a written statement by a competent body to the same effect; and

(e)a Test Report mentioned in Part 1 of Schedule 7, supported by:

(i)another test report stating that the item meets any requirements in the applicable standard that differ from the requirements in the standard under which the Test Report was given; or

(ii)a written statement by a certification body to the same effect; or

(iii)if it is impracticable to test the item because of its size, location or nature — a written statement by a competent body to the same effect; and

(f)an attestation of conformity mentioned in Part 2 of Schedule 7, supported by:

(i)a test report stating that the item meets any requirements in the applicable standard that differ from the requirements in the standard under which the attestation was made; or

(ii)a written statement by a certification body to the same effect; or

(iii)if it is impracticable to test the item because of its size, location or nature — a written statement by a competent body to the same effect; and

(g)for an item to which standard ACA TS 001-1997 or AS/NZS 60950-2000 applies — a certificate of approval or suitability mentioned in Part 3 of Schedule 7, supported by:

(i)a test report stating that the item meets any requirements in the applicable standard that differ from the requirements in the standard in relation to which the certificate was given; or

(ii)a written statement by a certification body to the same effect; or

(iii)if it is impracticable to test the item because of its size, location or nature — a written statement by a competent body to the same effect.

4.6Compliance level 3

(1)It the compliance level for an applicable standard is compliance level 3, the supplier must have enough of the information mentioned in subsection (2) to show that the item meets the requirements of the applicable standard.

Note 1   If the information in the compliance record is adequate to demonstrate that the item meets the requirements of an applicable standard, the information may be a single document from the list in subsection (2) or a combination of documents.

Note 2   The difference between compliance levels 2 and 3 is that all test reports for compliance level 3 must be obtained from a recognised testing authority.

(2)The information is:

(a)a test report by a recognised testing authority about one or more requirements of the applicable standard; and

(b)a written statement by a certification body about one or more requirements of the applicable standard; and

(c)if it is impracticable to test the item because of its size, location or nature — a written statement by a competent body certifying that reasonable efforts have been made to avoid a contravention of the applicable standard; and

(d)an approval mentioned in Part 1 of Schedule 7, supported by:

(i)a test report by a recognised testing authority stating that the item meets any requirements in the applicable standard that differ from the requirements in the standard, or the part of the standard, under which the approval was given; or

(iii)if it is impracticable to test the item because of its size, location or nature — a written statement by a competent body to the same effect; and

(f)an attestation of conformity mentioned in Part 2 of Schedule 7, supported by:

(i)a test report by a recognised testing authority stating that the item meets any requirements in the applicable standard that differ from the requirements in the standard under which the attestation was made; or

(ii)a written statement by a certification body to the same effect; or

(iii)if it is impracticable to test the item because of its size, location or nature — a written statement by a competent body to the same effect; and

(g)for an item to which standard ACA TS 001-1997 or AS/NZS 60950-2000 applies — a certificate of approval or suitability mentioned in Part 3 of Schedule 7, supported by:

(i)a test report by a recognised testing authority stating that the item meets any requirements in the applicable standard that differ from the requirements in the standard in relation to which the certificate was given; or

(ii)a written statement by a certification body to the same effect; or

(iii)if it is impracticable to test the item because of its size, location or nature — a written statement by a competent body to the same effect.

Note   A supplier should consult a recognised testing authority or a certification body if unsure about which provisions of an applicable standard are relevant to the modification.

(4)The supplier must not apply a compliance label to the modified item unless the item meets the requirements of each applicable standard against which it is tested.

(5)The supplier must complete a separate declaration of conformity for the modified item:

(a)showing the standards against which the unmodified item was tested; and

(b)the requirements in standards against which the modified item was tested in compliance with subsection (3).

(6)The supplier must keep a record of the results of each test carried out for subsection (3).

Part 6  Special requirements for changes to applicable standards or compliance levels

6.1Change to applicable standards

(1)This section applies if:

(a)an item was first manufactured or imported on or after 1 July 1997; and

(b)the item complied with each applicable standard; and

(c)the label that was applied to the item shows that the item complied with the applicable standards when it was first manufactured or imported; and

(d)the supplier has complied with Division 4.2 in relation to the applicable standards mentioned in paragraph (c).

(2)This section also applies to an exempt item if:

(a)the item does not bear a compliance label; and

(b)the item was first manufactured or imported on or after 1 July 1997; and

(c)the item complied with each applicable standard; and

(d)the supplier has complied with Division 4.2 in relation to the applicable standards mentioned in paragraph (c).

(3)If an applicable standard is amended, or a standard (the new standard) becomes an applicable standard, on or after the day on which the item was first manufactured or imported, the supplier:

(a)is not required to demonstrate whether the item complies with the applicable standard as amended or with the new standard; and

(b)is taken to have complied with Division 4.2 in relation to the applicable standard as amended and in relation to the new standard; and

(c)is taken to have complied with Part 3 in relation to the item and may continue to apply the label to the item.

(4)Subsection (3) does not apply if:

(a)the applicable standard is standard AS/ACIF S006-2001 or standard AS/ACIF S043.2-2003; and

(b)the item complies with any of the provisions mentioned in Schedule 6; and

(c)the supplier is not permitted to claim that the item is taken to comply with standard AS/ACIF S006-2001 or standard AS/ACIF S043.2-2003 without the need for demonstration.

(5)Subsection (3) does not apply if the applicable standard is ACA TS 034-1997 and, therefore, a supplier must comply with ACA TS 034-1997 as in force from time to time.

Note   Section 6.1 commenced on 18 April 2001. Former subsections 6.1 (4) and (5) (which set out circumstances in which an item was taken to comply with standard AS/ACIF S006-2001 or standard AS/ACIF S043.2-2003 without the need for demonstration) were repealed by the Telecommunications Labelling (Customer Equipment and Customer Cabling) Amendment Notice 2003 (No. 2), which commenced on 26 November 2003.

6.2Change to compliance levels

(1)This section applies to the supplier of an item if the supplier has complied with Division 4.2 in relation to the applicable standards for the item at the compliance levels specified for those standards when the item was first manufactured or imported.

(2)If the compliance level for any of those standards changes on or after the day on which the item was first manufactured or imported, the supplier:

(a)is not required to obtain additional information to show that the item meets the requirements of the applicable standard; and

(b)is taken to have complied with Division 4.2 in relation to that standard at the new compliance level.

Note 26   AS/ACIF S002-2001 was amended on 15 March 2002 by the Telecommunications Technical Standard (Analogue interworking and non-interference requirements for Customer Equipment for connection to the Public Switched Telephone Network — AS/ACIF S002) Amendment 2002 (No. 1) to make AS/ACIF S002-2001 as it existed in December 2001 and thereby incorporated industry’s amendment identified as ‘AS/ACIF S002-2001 (Amdt No. 1/2002)’ by date reference in the standard. AS/ACIF S002-2001 (Amdt 1) was made in 2004 to increase the visibility of amendments of standards mentioned in Part 2 of Schedule 1. As a result AS/ACIF S002-2001 (Amdt 1) has applied as an industry standard since 15 March 2002.
