Telecommunications (Interception) (State Provisions) (Amendment) Act

The Parliament of Victoria enacts as follows:

1. Purpose

The purpose of this Act is to amend the with the Telecommunications (Interception) Act 1979 of the Commonwealth which have resulted from amendments to the Commonwealth Act.

2. Commencement

This Act comes into operation on the day after the day on which it receives the Royal Assent.

3. Amendment of definitions

See:

Act No. In section 3(1) of the Telecommunications
46/1988. (Interception) (State Provisions) Act 1988—

as at (a) for the definition of "certifying officer"
10 October

1996.   substitute—

LawToday: 
' "certifying officer" has the same meaning
dpc.vic.  as in the Commonwealth Act in the
gov.au 
case of the Police Force of a State;';
(b)

for the definition of "communication" ' "communication" includes conversation

and a message, and any part of a

conversation or message, whether—

(a) in the form of—

(i) speech, music or other
sounds; or

(ii) data; or (iii) text; or

(iv)  visual images, whether or not animated; or

(v) signals; or

(b)

in any other form or in any combination of forms;';

(c) in the definition of "permitted purpose"—

(i)after paragraph (d) insert— "(da) the keeping of records by the

Police Force under sections 5, 6 and 9; or";

(ii)after paragraph (h) insert— "(ha) the making by a person of a

decision in relation to the
appointment, re-appointment,
term of appointment or retirement
of an officer or member of staff of

the Police Force; or

(hb) a review (whether by way of

appeal or otherwise) of a decision referred to in paragraph (ha); or";

(d) in the definition of "record"—

(i) at the end of paragraph (b) omit "or";

(ii) omit paragraph (c);

(e) in the definition of "restricted record"—

(i) omit "(a)";
(ii) at the end of the paragraph, omit "or";

(iii) omit paragraph (b).
