I, PHILIP MAXWELL RUDDOCK, Attorney-General, make this Instrument under subsection 6 (2D) of the Telecommunications (Interception) Act 1979.

  1. Name of Instrument

This Instrument is the Telecommunications (Interception) (Emergency Service Facility — South Australia) Instrument 2005.

  1. Commencement

This Instrument commences on the commencement of items 1 and 2 of Schedule 2 to the Crimes Legislation Amendment (Telecommunications Interception and Other Measures) Act 2005.

  1. Definitions

In this Instrument:

Act means the Telecommunications (Interception) Act 1979.

emergency service facility has the meaning given by subsection 6 (2A) of the Act.

ESF Declaration means the Telecommunications (Interception) (Emergency Service Facility) Declaration 2005.

  1. Emergency service facility

(1)   For subsection 6 (2D) of the Act and in relation to Division 5.1 of Schedule 1 to the ESF Declaration, the South Australia Police operates the premises located in the geographical region of Adelaide.

(2)   For subsection 6 (2D) of the Act and in relation to Division 5.2 of Schedule 1 to the ESF Declaration, the South Australia Metropolitan Fire Service operates the premises located in the geographical region of Adelaide.

(3)   For subsection 6 (2D) of the Act and in relation to Division 5.3 of Schedule 1 to the ESF Declaration, the South Australia Country Fire Service operates the premises located in the geographical region of Adelaide.

(4)   For subsection 6 (2D) of the Act and in relation to Division 5.4 of Schedule 1 to the ESF Declaration, the South Australia Ambulance Service operates the premises located in the geographical region of Eastwood.
