I, PHILIP MAXWELL RUDDOCK, Attorney-General, make this Instrument under subsection 6 (2D) of the Telecommunications (Interception) Act 1979.

  1. Name of Instrument

This Instrument is the Telecommunications (Interception) (Emergency Service Facility — Northern Territory) Instrument 2005.

  1. Commencement

This Instrument commences on the commencement of items 1 and 2 of Schedule 2 to the Crimes Legislation Amendment (Telecommunications Interception and Other Measures) Act 2005.

  1. Definitions

In this Instrument:

Act means the Telecommunications (Interception) Act 1979.

emergency service facility has the meaning given by subsection 6 (2A) of the Act.

ESF Declaration means the Telecommunications (Interception) (Emergency Service Facility) Declaration 2005.

  1. Emergency service facility

(1)   For subsection 6 (2D) of the Act and in relation to item 801 of Schedule 1 to the ESF Declaration, the Police Service of the Northern Territory and the Northern Territory Emergency Service operate the premises located in the geographical region of Alice Springs.

(2)   For subsection 6 (2D) of the Act and in relation to item 802 of Schedule 1 to the ESF Declaration, the Police Service of the Northern Territory operates the premises located in the geographical region of Tennant Creek.

(3)   For subsection 6 (2D) of the Act and in relation to Division 8.2 of Schedule 1 to the ESF Declaration, the Ambulance Service of the Northern Territory operates the premises located in the geographical region of Alice Springs.

(4)   For subsection 6 (2D) of the Act and in relation to Division 8.3 of Schedule 1 to the ESF Declaration, the Police Service of the Northern Territory, the Northern Territory Fire and Rescue Service and the Ambulance Service of the Northern Territory operate the premises located in the geographical region of Berrimah.
