I, PHILIP MAXWELL RUDDOCK, Attorney-General, make this Instrument under subsection 6 (2D) of the Telecommunications (Interception) Act 1979.

1. Name of Instrument

This Instrument is the Telecommunications (Interception) (Emergency Service Facility — New South Wales) Instrument 2005.

1. Commencement

This Instrument commences on the commencement of items 1 and 2 of Schedule 2 to the Crimes Legislation Amendment (Telecommunications Interception and Other Measures) Act 2005.

1. Definitions

In this Instrument:

Act means the Telecommunications (Interception) Act 1979.

emergency service facility has the meaning given by subsection 6 (2A) of the Act.

ESF Declaration means the Telecommunications (Interception) (Emergency Service Facility) Declaration 2005.

1. Emergency service facility 

(1)   For subsection 6 (2D) of the Act and in relation to Division 1.1 of Schedule 1 to the ESF Declaration, the Police Service of New South Wales operates the premises located in the following geographical regions:

(a)    Lithgow;

(b)    Newcastle;

(c)    Penrith;

(d)    Surry Hills;

(e)    Tamworth;

(f)    Tuggerah;

(g)    Wagga Wagga;

(h)    Warilla.

(2)   For subsection 6 (2D) of the Act and in relation to Division 1.2 of Schedule 1 to the ESF Declaration, the New South Wales Fire Brigades operate the premises located in the following geographical regions:

(a)    Alexandria;

(b)    Katoomba;

(c)    Newcastle;

(d)    Wollongong.

(3)   For subsection 6 (2D) of the Act and in relation to Division 1.3 of Schedule 1 to the ESF Declaration, the Ambulance Service of New South Wales operates the premises located in the following geographical regions:

(a)    Barrack Heights;

(b)    Charlestown;

(c)    Dubbo;

(d)    Eveleigh;

(e)    Kogarah;

(f)    Rozelle.

(4)   For subsection 6 (2D) of the Act and in relation to Division 1.4 of Schedule 1 to the ESF Declaration, Telstra operates the premises located in the geographical region of Sydney.
