  1. Name of Instrument

This Instrument is the Telecommunications (Interception) (Emergency Service Facility — Australian Capital Territory) Instrument 2005.

  1. Commencement

This Instrument commences on the commencement of items 1 and 2 of Schedule 2 to the Crimes Legislation Amendment (Telecommunications Interception and Other Measures) Act 2005.

  1. Definitions

In this Instrument:

Act means the Telecommunications (Interception) Act 1979.

ACT means the Australian Capital Territory.

emergency service facility has the meaning given by subsection 6 (2A) of the Act.

ESF Declaration means the Telecommunications (Interception) (Emergency Service Facility) Declaration 2005.

  1. Emergency service facility

(1)   For subsection 6 (2D) of the Act and in relation to Division 7.1 of Schedule 1 to the ESF Declaration, the Australian Federal Police — ACT Community Policing operates the premises located in the geographical regions of Belconnen and Greenway.

(2)   For subsection 6 (2D) of the Act and in relation to Division 7.2 of Schedule 1 to the ESF Declaration, the ACT Fire Brigade and the ACT Ambulance Service operate the premises located in the geographical region of Curtin.
