I, ROBERT McCLELLAND, Attorney-General, make this Instrument under subsection 6(2B) of the Telecommunications (Interception and Access) Act 1979.

1              Name of Instrument

This Instrument is the Telecommunications (Interception and Access) (Emergency Services Facilities — Australian Capital Territory) Amendment Instrument 2010.

2              Commencement

This Instrument commences as follows:

(a)     on 2 May 2010 — Sections 1 to 3 and Schedule 1;

(b)     on 5 May 2010 — Schedule 2.

3              Amendment of Telecommunications (Interception and Access) (Emergency Services Facilities — Australian Capital Territory) Instrument 2008

Schedules 1 and 2 amend the Telecommunications (Interception and Access) (Emergency Services Facilities — Australian Capital Territory) Instrument 2008.

Schedule 1        Amendments commencing on 2 May 2010

(section 3)

[1]           Section 4, definition of ACT ESF Declaration

omit

as existing on the commencement of this Instrument.

insert

as in force on 1 May 2010.

[2]          Paragraph 5 (1) (b)

substitute

(b)    the Australian Federal Police — AFP Operations Coordination Centre operates:

(i)    the premises located in the geographical region of Canberra City; and

(ii)    the premises located in the geographical region of Fairbairn.
