I, ROBERT McCLELLAND, Attorney-General, make this Instrument under subsection 6(2D) of the Telecommunications (Interception and Access) Act 1979.

1              Name of Instrument

This Instrument is the Telecommunications (Interception and Access) (Emergency Service Facilities — Australian Capital Territory) Instrument 2010.

2              Commencement

This Instrument commences on 13 August 2010.

3              Revocation

The Telecommunications (Interception and Access) (Emergency Service Facilities — Australian Capital Territory) Instrument 2008 is revoked.

4              Definitions

In this Instrument:

Act means the Telecommunications (Interception and Access) Act 1979.

ACT ESF Declaration means the Telecommunications (Interception and Access) (Emergency Service Facilities — Australian Capital Territory) Declaration 2010 as existing on 13 August 2010.

5              Emergency service facilities

(1) For subsection 6(2D) of the Act, and in relation to Part 1 of Schedule 1 to the ACT ESF Declaration:

(a)   the Australian Federal Police — ACT Policing Operations operates the premises located in the geographical regions of Belconnen and Greenway; and

(b)   the Australian Federal Police — the Australian Federal Police operates the premises located in the geographical regions of Fairbairn and Barton.        

(2) For subsection 6(2D) of the Act, and in relation to Part 2 of Schedule 1 to the ACT ESF Declaration, the Australian Capital Territory Emergency Services Agency operates the premises located in the geographical region of Curtin.
