  1. Name of Determination

This Determination is the Telecommunications (Freephone and Local Rate Numbers Auctions – Registration Charge) Determination 2004 (No. 2).

  1. Commencement

This Determination commences on the date of its notification in the Gazette.

  1. Revocation

The Telecommunications (Freephone and Local Rate Numbers Auctions – Registration Charge) Determination 2004, notified in the Gazette on 16 June 2004, is revoked.

  1. Definitions

In this Determination, unless the contrary intention appears:

ACA Act means the Australian Communications Authority Act 1997.

Charities Determination means the Telecommunications (Freephone and Local Rate Numbers - Charities) Allocation Determination 2004 (No. 2).

Commercial Determination means the Telecommunications (Freephone and Local Rate Numbers) Allocation Determination 2004 (No. 2).

Determinations means the Charities Determination and the Commercial Determination.

GST has the meaning given by section 195-1 of the A New Tax System (Goods and Services Tax) Act 1999.

Telecommunications Act means the Telecommunications Act 1997.

Note The following expression used in this Determination is defined in the Telecommunications Act:

·ACA.

  1. Purpose of this Determination

(1)Under subsection 53 (1) of the ACA Act, the ACA may make determinations fixing charges for:

(a)services and facilities provided by the ACA; and

(b)any matter in relation to which expenses are incurred by the ACA under specified Acts (including the Telecommunications Act).

(2)Section 463 of the Telecommunications Act provides that the ACA may, by written instrument, determine an allocation system for allocating specified numbers to carriage service providers.  The ACA has determined such an allocation system by making the Determinations.

(3)The ACA will incur expense in providing the registration facilities set down in the Determinations.

(4)This determination fixes the charge that is to be applied in relation to those expenses.

  1. Charge

(1)The charge mentioned in column 2 of an item in Schedule 1 is the amount mentioned in column 3 of the item.

(2)The charge includes GST, if applicable.

  1. By whom and when is the charge payable

(1)Subject to subsection (2), the charge is payable by the applicant for registration in accordance with and at the time required by the Determinations.

(2)An eligible charity within the meaning of the Charities Determination is not liable to pay the charge, irrespective of whether the application for registration is lodged under the Commercial Determination or the Charities Determination.
