Telecommunications (Fibre-ready facilities- Exempt Kiangatha Real Estate Development Projects) Instrument No.1 of 2016

I, MITCH FIFIELD, Minister for Communications, make this Instrument under paragraphs 372K(1)(a), (c), (d), (e) and (f) of the Telecommunications Act 1997.

1              Name of Instrument

This Instrument is the Telecommunications (Fibre-ready facilities- Exempt Kiangatha Real Estate Development Projects) Instrument No.1 of 2016.

2              Commencement

This Instrument commences on the day after it is registered on the Federal Register of Legislation.

3              Definitions

In this Instrument:

Act means the Telecommunications Act 1997.

Kiangatha means Kiangatha Holdings Pty Limited (ACN 136 533 741), a company incorporated in New South Wales.

Specified Kiangatha Project means each real estate development project:

a.owned by Kiangatha as at 1 May 2016;

b.specified in column 1 of the table at Schedule 1to this Instrument; and

c.situated within an area of land for the project as depicted in the corresponding map at Annexure A to Schedule 1 to this Instrument (refer to column 2 of the table at Schedule 1).

Note:             The following words and expressions used in this Instrument have the meaning given by section 7 of the Act (see subsection 13(1) of the Legislation Act 2003):

-     project area; and

-      real estate development project.

4          Exempt real estate development projects

Pursuant to paragraph 372K(1)(a) of the Act, each Specified Kiangatha Project is exempt from the requirements in sections 372E, 372F, 372G and 372H of the Act.
