  1. Name of Determination

This Determination is the Telecommunications (Exemption from Annual Charge) Determination 2005.

  1. Commencement

This Determination commences on the day after it is registered.

  1. Revocation — Telecommunications (Exemption from Annual Charge) Determination 2003

The Telecommunications (Exemption from Annual Charge) Determination 2003 is revoked.

  1. Definitions

In this Determination:

Act means the Telecommunications (Numbering Charges) Act 1997.

calling card service has the same meaning as in the numbering plan.

community service has the same meaning as in the numbering plan.

ENUM has the same meaning as in the numbering plan.

ENUM trial has the same meaning as in the numbering plan.

ENUM trial number has the same meaning as in the numbering plan.

geographic number has the meaning given in section 3.3 of the numbering plan.

international signalling point code has the meaning given in section 5A.1 of the numbering plan.

telex number has the meaning given in section 5.3 of the numbering plan.

Note   A number of expressions used in this Determination are defined in the Act, (see section 5), including:

·allocation

·carriage service provider

·number

·numbering plan

·standard telephone service.

  1. Purpose of Determination

(1)Under subsection 18 (1) of the Act, charge is imposed on an allocated number if a carriage service provider holds the number at the beginning of a day determined by the ACA under subsection 18 (2).

Note   Under subsection 18 (2) of the Act, the ACA must, before 16 February in each year, determine in writing a day in April in that year.

(2)Under subsection 22 (2) of the Act, the ACA may, by written determination, exempt a specified number from charge.

(3)This Determination specifies the numbers exempt from charge.

  1. Numbers used for community services

A number specified in the numbering plan for use for a community service is exempt from charge.

  1. Geographic numbers

A geographic number, other than a geographic number allocated to a carriage service provider for the purposes of providing a standard telephone service to a customer, is exempt from charge.

Note   A geographic number allocated to a carriage service provider for the purposes of providing a standard telephone service to a customer is exempt from charge under subsection 22 (1) of the Act.

  1. International signalling point codes

An international signalling point code is exempt from charge.

  1. Telex numbers

A telex number is exempt from charge.

  1. Country calling card number — 18919

Calling card service number 18919 is exempt from charge.

Note   Calling card service number 18919 provides calling card service to indigenous communities.

  1. ENUM trial numbers

ENUM trial numbers are exempt from charge.
