Telecommunications (Carrier Licence Fees) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Telecommunications (Carrier Licence Fees) Act 1991.

1.   Commencement

1.1   These Regulations commence on 30 June 1995.

2.   Amendment

2.1   The Telecommunications (Carrier Licence Fees) Regulations are amended as set out in these Regulations.

3.   Regulation 2 (Interpretation)

3.1   Subregulation 2 (1):

After the definition of “excluded money”, insert:

“ ‘ITU component’, in relation to a fee that is payable under the Act in a calendar year, means the amount determined under regulation 4 for the calendar year;”.

4.   Regulation 3 (Amount of licence fee)

4.1   Subregulation 3 (1):

Omit “(RFY appropriation—excluded money)”, substitute “((RFY appropriation—excluded money) + ITU component)”.

4.2   Subregulation 3 (2):

Omit “the PY appropriation,”, substitute “the sum of the PY appropriation and the ITU component,”.

4.3   Subregulation 3 (2):

Omit “(PY appropriation—received fees)”, substitute “((PY appropriation—received fees)  +  ITU component)”.

4.4   Subregulation 3 (3):

Omit “the PY appropriation,”, substitute “the sum of the PY appropriation and the ITU component,”.

4.5   Subregulation 3 (3):

Omit “PY appropriation  x  carrier’s traffic share.”, substitute “(PY appropriation + ITU component)  x  carrier’s traffic share.”.

5.   New regulation 4

5.1   Add at the end of the Regulations:

Limit on annual fees—proportion of Commonwealth’s contribution to ITU budget

For the purposes of paragraph 6 (b) of the Act, the amount given by the following formula is determined for a calendar year:

where:

‘contribution’ is the Commonwealth’s contribution to the total budget of the International Telecommunication Union.”.
