I, HELEN LLOYD COONAN, Minister for Communications, Information Technology and the Arts, make the following Determination under paragraph 51(1)(c) of the Telecommunications Act 1997.

1. Name of Determination

This Determination is the Telecommunications (Carrier Licence Exemption) Determination No. 1 of 2001 (Amendment No. 1 of 2006).

1. Commencement

This Determination commences on the day after it is registered on the Federal Register of Legislative Instruments.

3     Amendment of the Telecommunications (Carrier Licence Exemption) Determination No. 1 of 2001

Schedule 1 amends the Telecommunications (Carrier Licence Exemption) Determination No. 1 of 2001.

This Determination ceases to have effect on the earliest digital television switch-over day.

insert after the definition of ‘datacasting licence’:

earliest digital television switch-over day means the earliest day on which a simulcast period (within the meaning of Schedule 4 of the Broadcasting Services Act 1992) ends.
