The AUSTRALIAN COMMUNICATIONS AND MEDIA AUTHORITY makes this Determination under subsection 14 (1) of the Telecommunications (Carrier Licence Charges) Act 1997.

Name of Determination
This Determination is the Telecommunications (Annual Carrier Licence Charge) Determination 2010.
Commencement
This Determination commences on the day after it is registered.
Application
This Determination applies on and after the later of:
(a) the day after it is registered; and
(b) the day after the commencement of the Telecommunications (Specification of Costs by ACMA) Determination 2010.
Definitions
In this Determination:
Act means the Telecommunications (Carrier Licence Charges) Act 1997.
carrier licence charge means charge within the meaning of Part 3 of the Act.
Method of ascertaining carrier licence charge
The amount of carrier licence charge imposed on a carrier licence in force at the beginning of the financial year that began on 1 July 2009, in relation to a carrier mentioned in an item in Schedule 1, is ascertained using the formula:
where:
MFC (minimum fixed charge) is $285.
MCA (maximum charge amount) is $39 769 672 being the total sum of the amounts determined under subsection 15 (1) of the Act.
OTC (other telecommunications charge) is $220 920.
Note This is the amount of the ACMA’s costs for the 2008–2009 financial year that:
(a) is attributable to the ACMA’s telecommunications functions and powers; and
(b) has been recovered from telecommunications charges other than annual carrier licence charges.
The amount of the ACMA’s costs for the 2008–2009 financial year that is attributable to the ACMA’s telecommuncations functions and powers is $23 828 445 — see section 4 of the Telecommunications (Specification of Costs by ACMA) Determination 2010.
TNC (total number of carriers) is 175.
Note This is the total number of carriers mentioned in Schedule 1.
ER (eligible revenue), for the carrier, is the amount mentioned in the item in Schedule 1.
Note This amount is the carrier’s eligible revenue for the 2008–2009 financial year as assessed by the ACMA under subsection 20F (1) of the Telecommunications (Consumer Protection and Service Standards) Act 1999.
TER (total eligible revenue) is $28 099 315 298.
Note This amount is the sum of the eligible revenue for the 2008–2009 financial year for each carrier mentioned in Schedule 1.
