Name of Determination
This Determination is the Telecommunications (Annual Carrier Licence Charge) Determination 2005.
Commencement
This Determination commences on the day after it is registered.
Definitions
In this Determination:
Act means the Telecommunications (Carrier Licence Charges) Act 1997.
carrier licence charge means the annual charge:
(a) imposed on a carrier licence under Part 3 of the Act; and
(b) ascertained in accordance with this Determination.
Method of ascertaining carrier licence charge
The amount of carrier licence charge imposed on a carrier licence in force at the beginning of the financial year that began on 1 July 2004, in relation to a carrier mentioned in Part 1 of Schedule 1, is ascertained using the formula:
MFC + [MCA-(OTC+(MFCx TNC))] x ER/TER
where:
MFC (minimum fixed charge) is $455
MCA (maximum charge amount) is the sum of the amounts determined under subsection 15 (1) of the Act.
OTC (other telecommunications charge) is $90 334.
Note 1 The other telecommunications charge is the proportion of the ACA’s costs for the 2003–2004 financial year that:
(a) is attributable to the ACA’s telecommunications functions and powers; and
(b) will be recovered from telecommunications charges other than carrier licence charges.
Note 2 The proportion of the ACA’s costs for the 2003–2004 financial year that is attributable to the ACA’s telecommunications functions and powers is $25 171 322— see the Telecommunications (Costs Attributable to Telecommunications Functions and Powers) Determination 2004.
TNC (total number of carriers) is 99.
Note The total number of carriers is the total number of carriers mentioned in Part 2 of Schedule 1.
ER (eligible revenue), for a carrier mentioned in an item in Part 1 of Schedule 1, is the amount mentioned in the item.
Note Eligible revenue, for a carrier, is the carrier’s eligible revenue for the 2003–2004 financial year as assessed by the ACA under subsection 20F (1) of the Telecommunications (Consumer Protection and Service Standards) Act 1999.
TER (total eligible revenue) is $23 635 688 639.
Note Total eligible revenue is the amount mentioned in Part 2 of Schedule 1, which is the sum of the eligible revenue for the 2003–2004 financial year for all the carriers mentioned in Part 1 of Schedule 1.
