1Name of Regulations

These Regulations are the Telecommunications Amendment Regulations 2002 (No. 2).

2Commencement

These Regulations commence on gazettal.

3Amendment of Telecommunications Regulations 2001

Schedule 1 amends the Telecommunications Regulations 2001.

insert

5.4Disclosure of information — assistance to Royal Commission into whether there has been any corrupt or criminal conduct by Western Australian police officers

1. (1)

   For subsection 292 (1) of the Act, the following circumstances apply to a disclosure or use of information or a document:

   1. (a)

      the disclosure is made by an eligible person;

   2. (b)

      the disclosure is made to the Royal Commission created under section 5 of the Royal Commissions Act 1968 (WA) by instrument of Commission dated 12 December 2001;

   3. (c)

      the disclosure is made solely for the purposes of the Royal Commission.

Note The effect of this subregulation is that section 276 of the Act will not prohibit a disclosure or use of information or a document in the circumstances specified in the subregulation.

   For subsection 292 (2) of the Act, the following circumstances apply to a disclosure or use of information or a document:

   1. (a)

      the disclosure is made by an eligible number-database person;

   2. (b)

      the disclosure is made to the Royal Commission created under section 5 of the Royal Commissions Act 1968 (WA) by instrument of Commission dated 12 December 2001;

   3. (c)

      the disclosure is made solely for the purposes of the Royal Commission.

Note The effect of this subregulation is that section 277 of the Act will not prohibit a disclosure or use of information or a document in the circumstances specified in the subregulation.

   For subsection 292 (3) of the Act, the following circumstances apply to a disclosure or use of information or a document:

   1. (a)

      the disclosure is made by an emergency call person;

   2. (b)

      the disclosure is made to the Royal Commission created under section 5 of the Royal Commissions Act 1968 (WA) by instrument of Commission dated 12 December 2001;

   3. (c)

      the disclosure is made solely for the purposes of the Royal Commission.

Note The effect of this subregulation is that section 278 of the Act will not prohibit the disclosure or use of information or a document in the circumstances specified in the subregulation.
