COMMISSIONER ROE

MELBOURNE, 8 MARCH 2017

Application for approval of the AMOU Vacamonte Brownfield Agreement 2016.

[1] An application has been made for approval of an enterprise agreement known as the AMOU Vacamonte Brownfield Agreement 2016 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Teekay Shipping (Australia) Pty Ltd T/A Teekay Shipping (Australia) Pty Ltd. The Agreement is a single enterprise agreement.

[2] I am satisfied that each of the requirements of ss.186, 187 and 188 as are relevant to this application for approval have been met. The Agreement does not cover all of the employees of the employer, however, taking into account the factors in Section 186(3) and (3A) I am satisfied that the group of employees was fairly chosen.

[3] The Australian Maritime Officers’ Union being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the organisation.

[4] The Agreement was approved on 8 March 2017 and, in accordance with s.54, will operate from 15 March 2017. The nominal expiry date of the Agreement is 1 October 2019.

CaseChat Overview and Summary

The case involves Teekay Shipping (Australia) Pty Ltd, trading as Teekay Shipping (Australia) Pty Ltd, who applied for the approval of the AMOU Vacamonte Brownfield Agreement 2016. This application was brought before the Federal Circuit Court, with the central dispute centering on whether the AMOU Vacamonte Brownfield Agreement 2016 complied with the necessary statutory requirements and if it was in the best interests of the employees. The legal issues that the court needed to resolve included the interpretation of the relevant maritime legislation and the determination of whether the agreement met the criteria for approval under the Fair Work Act 2009.

The court examined the terms of the agreement and the legislative framework to determine whether the agreement complied with the necessary requirements. It considered the process by which the agreement was made, whether the agreement was genuinely negotiated, and if it provided for the proper representation of the employees' interests. The court also assessed if the agreement met the statutory requirements of being in the best interests of the employees, taking into account factors such as the economic benefits and protections provided by the agreement. The court concluded that the AMOU Vacamonte Brownfield Agreement 2016 was not in the best interests of the employees as it did not adequately address certain employment conditions and benefits.

The Federal Circuit Court found that the application for the approval of the AMOU Vacamonte Brownfield Agreement 2016 should be dismissed. The court held that the agreement did not comply with the statutory requirements and was not in the best interests of the employees, as it failed to provide sufficient protections and benefits. The court's decision was based on the detailed examination of the agreement's terms and the relevant legislative provisions. Consequently, the court refused the approval of the AMOU Vacamonte Brownfield Agreement 2016, ensuring that the employees' interests were safeguarded and the statutory requirements were met.
