His Excellency the Governor, with the advice of the Executive Council, has approved of the following By-law under the Technical Education Trust Funds Act 1967.

Explanatory note
The objects of this By-law are as follows:

(a)

to provide that the Noel Chettle Memorial Art Prize may be awarded on an annual or biennial basis, depending on the sufficiency of income in the Noel Chettle Memorial Art Prize Fund to support the award,

(b)

to remove the age and residency restrictions applying to entrants and to modify certain conditions applying to the works accompanying an entry,

(c)

to update certain references to teaching programs and office holders in the conditions of entry and to change the date by which entries must be lodged,

(d) to make a number of consequential amendments.

This By-law is made under section 14 of the Technical Education Trust Funds Act

1967.

In accordance with the Technical Education Trust Funds Act 1967 and as the Statutory Trustee of the Noel Chettle Memorial Art Prize Fund, I make the By-law set out below and certify that I have had regard to the intentions of the donor of the Fund, as expressed by the trust instrument relating to the Fund.

(Clause 2)

[1]     Clause 14 Noel Chettle Memorial Art Prize Fund

Omit clause 14 (2). Insert instead:

(2)

The Noel Chettle Memorial Art Prize may be awarded in any year to a student at a TAFE establishment who, as at 30 September in that year, is enrolled in a course of training conducted as part of the Fine Arts or Visual Arts programs.

(2A) The Noel Chettle Memorial Art Prize is to be awarded annually or, if the Statutory Trustee of the Fund determines that income in the Fund is insufficient to support an annual award, biennially. If the Statutory Trustee determines that the Noel Chettle Memorial Art Prize is to be awarded in any year, the Trustee is to publish a notice to that effect by 31 March in that year, in a magazine, newspaper or periodical circulating among students of TAFE establishments.

Omit “31 March”. Insert instead “30 September”.

[3]     Clause 14 (3) and (8) (a)

Omit “Head of the School of Art and Design” wherever occurring.
Insert instead “Program Manager, Fine Art and Contemporary Craft”.
Omit “and date of birth”.
Omit the paragraph.

[6]     Clause 14 (4) (e)

Omit the paragraph. Insert instead:

(e) be verified in writing by a teacher of the Fine Arts or Visual Arts programs who is teaching the course of training in which the entrant is currently enrolled, or who is of or above the rank of head teacher.

[7]     Clause 14 (5) (d)

Omit “of”. Insert instead “that includes”.

[8]     Clause 14 (6) (a)

Omit the paragraph. Insert instead:

(a) must, in the case of the life portrait, have dimensions not exceeding 1200 millimetres by 1200 millimetres and, in the case of the other works, have dimensions not exceeding 900 millimetres by 1200 millimetres, and

[9]     Clause 14 (6) (c)

Omit “must be executed in pencil or ink”. production of a drawn work”.
