TEACHING SERVICE (AMENDMENT) ACT.

Act No. 5, 1972.

An Act to make provisions with respect to the transfer of persons employed under the Public Service Act, 1902, to the Teaching Service and with respect to the constitution of promotions committees under the Teaching Service Act, 1970; for these and other purposes to amend that Act; and for purposes connected therewith. [Assented to, 6th March, 1972.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in

Parliament assembled, and by the authority of the same. follows: —

1 . This Act may be cited as the "Teaching Service

(Amendment) Act, 1972".

2.      The Teaching Service Act, 1970, is amended—

(a) by inserting in paragraph (b) of subsection one of section seventeen after the words "teachers' colleges" the words ", not being teachers' colleges that are colleges of advanced education within the meaning of the Higher Education Act, 1969";
(b) by inserting next after subsection one of section twenty-three the following new subsection :—

(1A) Notwithstanding the provisions of section twenty-seven of this Act, the Director-General, with the concurrence of the Public Service Board and with the written consent of the person concerned, may appoint an officer under the Public Service Act, 1902, to a permanent office in the Teaching Service and that officer shall thereupon cease to be employed under that Act and shall be employed in the Teaching Service subject to such conditions of employment, including salary, wages and remuneration, as may be determined by the Public Service Board after consultation with the Director-

General and such other conditions as may be

determined by the Director-General.

(c) (i) by inserting next after subsection one of

section twenty-four the following new

subsection :—

(1A) The Director-General, with the

concurrence of the Public Service Board and with the written consent of the person

concerned,

concerned, may appoint temporarily to any office to which the Director-General is entitled to make an appointment under section twenty-three of this Act an officer or employee under the Public Service Act, 1902, and that officer or employee shall thereupon cease to be employed under that Act and shall be employed in the Teaching Service subject to such conditions of employment, including salary, wages and remuneration, as may be determined by the Public Service Board after consultation with the Director-General and such other conditions as may be determined by the Director-General.

(ii)   by inserting in subsection two of the same section after the word "one" the word,

symbols and figure "or ( 1 A ) " ;

(d) (i) by inserting in paragraph (a) of subsection one of section twenty-nine after the words "an officer" the words ", or an officer under the Public Service Act, 1902,";

(ii)   by omitting from paragraph (c) of the same subsection the words "an officer" and by inserting in lieu thereof the words "a person".
