Teachers Registration Amendment Act 2003

An Act to amend the Teachers Registration Act 2000

[Royal Assent 9 May 2003]

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Teachers Registration Amendment Act 2003 . 2CommencementThis Act commences on the day on which this Act receives the Royal Assent. 3Principal ActIn this Act, the Teachers Registration Act 2000 is referred to as the Principal Act. 4Section 13 amended (Registration) Section 13(2) of the Principal Act is amended as follows: (a) by omitting "2" and substituting "3"; (b) by omitting "following" and substituting "third". 5Section 13A insertedAfter section 13 of the Principal Act , the following section is inserted in Part 3: 13AExtension of registration (1)  A person whose registration expires on 31 December 2003 may apply to the Board for an extension of his or her registration until 31 December 2004. (2)  A person whose registration expires on 31 December 2004 may apply to the Board for an extension of his or her registration until 31 December 2005. (3)  An application is to be – (a) in an approved form; and (b) accompanied by the prescribed fee. 6Section 14 amended (Renewal of registration) Section 14(3) of the Principal Act is amended by inserting "for such period not exceeding 3 years as is determined by the Board" after "a person". 7Section 14A insertedAfter section 14 of the Principal Act , the following section is inserted in Part 3: 14APayment of annual registration fee (1)  A person who is registered, or whose registration is renewed, for a period of more than one year is to pay an annual registration fee prescribed in the regulations for each year, excluding the first year, for which the registration is granted or renewed. (2)  The fee referred to in subsection (1) is to be paid on or before 31 December in each year during the currency of the registration. 8Section 15 substituted Section 15 of the Principal Act is repealed and the following section is substituted: 15Certificate of registration (1)  The Board is to issue a certificate of registration in an approved form to a person registered under section 13 or whose registration is renewed under section 14 . (2)  The Board is to issue a certificate of provisional registration in an approved form to a person who is granted provisional registration under section 16(1) or whose provisional registration is extended under section 16(3) . 9Section 16 amended (Criteria for provisional registration) Section 16 of the Principal Act is amended as follows: (a) by omitting from subsection (2) "2" and substituting "3"; (b) by omitting from subsection (3) "not exceeding 2 years" and substituting "so long as the total length of the period of provisional registration does not exceed 4 years". 10Section 16A insertedAfter section 16 of the Principal Act , the following section is inserted in Part 3: 16AExtension of provisional registration (1)  A person whose provisional registration expires on 31 December 2003 may apply to the Board for an extension of his or her registration until 31 December 2004. (2)  A person whose provisional registration expires on 31 December 2004 may apply to the Board for an extension of his or her registration until 31 December 2005. (3)  An application is to be – (a) in an approved form; and (b) accompanied by the prescribed fee. 11Section 25 amended (Register) Section 25 of the Principal Act is amended as follows: (a) by omitting from subsection (2)(a) "and any former name"; (b) by inserting the following paragraph after paragraph (a) in subsection (2) : (ab) any former name; (c) by inserting in subsection (2)(f) "or limited authority number" after "number"; (d) by inserting the following paragraph after paragraph (h) in subsection (2) : (ha) expiry date of registration; (e) by inserting the following paragraph after paragraph (i) in subsection (2) : (ia) particulars of limited authority; (f) by omitting subsection (4) and substituting the following subsections: (4)  The Board, on request – (a) must make available only the particulars of the register referred to in subsection (2)(a) , (f) , (g) and (ha) ; and (b) may make available to a teacher employing authority the particulars of the register referred to in subsection (2)(c) , (d) , (i) and (ia) and any other particulars in respect of which the registered teacher has given his or her consent. (5)  For the purpose of subsection (4) , teacher employing authority means the Department, the Catholic Education Office, Hobart or a person or body referred to in section 51 of the Education Act 1994 . 12Section 26 amended (Removal of name from register) Section 26 of the Principal Act is amended as follows: (a) by omitting from paragraph (e) " section 17 or section 24 ." and substituting " section 17 or section 24 ; or"; (b) by inserting the following paragraph after paragraph (e) : (f) the person has not paid the relevant prescribed annual registration fee by the due date. 13Section 27 amended (Employing unregistered persons) Section 27 of the Principal Act is amended as follows: (a) by omitting "teacher or" and substituting "teacher,"; (b) by inserting "or is not under the direct supervision of a registered teacher" after "authority". 14Section 32 amended (Annual returns) Section 32 of the Principal Act is amended as follows: (a) by inserting "by not later than 1 August in each year" after "Board"; (b) by omitting "each" and substituting "that".
