His Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Teacher Accreditation Act 2004.

Explanatory note
The object of this Regulation is to make miscellaneous amendments to the Teacher Accreditation Regulation 2010 as a consequence of the amendments made to the Teacher Accreditation Act 2004 by the Teacher Accreditation Amendment Act 2014. In particular, this Regulation makes provision for the election of a representative of early childhood education centre teachers as a member of the Quality Teaching Council.

This Regulation is made under the Teacher Accreditation Act 2004 (as amended by the Teacher Accreditation Amendment Act 2014), including sections 13 (1) (a) and 52 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Teacher Accreditation Amendment Regulation 2014.

2      Commencement

This Regulation commences on 5 January 2015 and is required to be published on the
NSW legislation website.

2010

[1]      Clause 3 Definitions

Omit the definitions of Chief Executive, new scheme teacher and transition scheme teacher.

[2]      Clause 3 (1)

Insert in alphabetical order:

election of a representative of early childhood education centre teachers means an election for the purposes of electing a representative of early childhood education centre teachers as a member of the Council for the purposes of section 13 (1) (a) of the Act.

[3]      Clause 4 Additional particulars on accreditation list

Omit clause 4 (i). Insert instead:

(i)      in the case of a person who is conditionally accredited under section 31 (3) (a) of the Act—details of the proposal by the person to complete a teaching qualification.

[4]      Clause 5 Conditions of accreditation

Omit “section 23 (3)”. Insert instead “section 23A (1)”.

[5]      Clause 5 (c) (ii)

Omit the subparagraph. Insert instead:

(ii)      in the case of a person who is conditionally accredited under section 31 (3) (a) of the Act—any change, during the previous year, in relation to the proposal by the person to complete a teaching qualification.

[6]      Clauses 6–9 and 11

Omit the clauses.

[7]      Clause 10 Determination of equivalent time for casual or part-time teachers

Omit “section 30 (5)” from clause 10 (1). Insert instead “section 30 (6)”.

[8]      Clause 10 (2)

Omit “section 31 (7)”. Insert instead “section 31 (5)”.

[9]      Clause 12 Exemption from requirement to employ accredited teachers only

Omit “section 29 or 35” from clause 12 (1). Insert instead “section 28 (2)”.

[10]      Clause 13 Definitions

Insert after paragraph (f) of the definition of election:

(g)

an election of a representative of early childhood education centre teachers.

Omit clause 21 (2) (a) (vi). Insert instead:

(vi)      a representative of independent school teachers, or

(vii)      a representative of early childhood education centre teachers, and

[17]      Clause 24 Qualifications to be nominated

Insert after clause 24 (7):

(8) Election of representative of early childhood education centre teachers
Any person who, at the time of nomination:
(a) is enrolled as a person employed to teach in an early childhood education centre, and
(b) is employed full-time or part-time as a teacher in an early childhood education centre,
is qualified to be nominated as a candidate for an election of a representative
of early childhood education centre teachers.

[18]      Clause 70 Maintenance of electoral list

Insert after clause 70 (1) (b) (vii):

(viii)      any person who is enrolled only as a person employed to teach in an early childhood education centre is entitled to vote at an election of a representative of early childhood education centre teachers on the Council,

Insert at the end of clause 70 (2) (a) (iii):

or

(iv)      an election of a representative of early childhood education centre teachers on the Council,

[20]      Clause 71 Eligibility to be enrolled

Omit “/ACT” from clause 71 (b).

[21]      Schedule 1 Forms

Insert “/Early childhood education centre” after “School” in Form 1.

[22]      Schedule 3 Fees

Omit “professional accomplishment” wherever occurring.
Insert instead “highly accomplished teacher”.

Omit “professional leadership” wherever occurring. Insert instead “lead teacher”.

[24]      Schedule 3

Omit “(other than transition scheme teachers who are conditionally accredited)”.
