TC v Public Guardian & Ors

The parties involved in this matter were TC, the nephew of TD, and the Public Guardian, who was appointed as TD's financial manager. TC sought a guardianship order over TD, which was dismissed by the Guardianship Tribunal on 4 August 2005. TC further appealed this decision to the Supreme Court, which was subsequently dismissed. TC then sought a review of the decision of the Guardianship Tribunal by the Supreme Court.

The primary legal issues before the court were the correct application of the relevant statutory provisions governing the appointment of a financial manager and the process by which a guardianship order should be considered and granted. The court was required to determine whether the Guardianship Tribunal had properly exercised its discretion and whether there were grounds for setting aside its decision.

The court found that the Guardianship Tribunal had not properly considered all relevant evidence and circumstances in making its decision to dismiss TC's application for a guardianship order. The court was of the view that the Tribunal had failed to adequately assess the capacity of TD and the suitability of TC to be appointed as a guardian. The court concluded that the Tribunal's decision was therefore flawed and could not be supported. As a result, the court set aside the decision of the Guardianship Tribunal and remitted the matter back to the Tribunal for reconsideration.

The court made an order setting aside the decision of the Guardianship Tribunal made on 4 August 2005, to dismiss TC's application for a guardianship order in relation to TD. The court also ordered that the matter be remitted back to the Tribunal for reconsideration in accordance with the court's reasons. The court did not make any orders in relation to the review of the decision of the Guardianship Tribunal by the Supreme Court.
