AND CONTROL).

No. 27 of 1978.

AN ACT to amend the Taxi-cars (Co-ordination and

Control) Act, 1963-1977.

[Assented to 18th May, 1978.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:-

Short title

1. (1) This Act may be cited as the Taxi-cars

and

(Co-ordination and Control) Act Amendment Act,

This Act shall come into operation on a date

to be fixed by proclamation.

Subsection (1) of section 3 of the principal

Act is amended by adding after the interpretation

"owner" the following interpretation

"secretary" means the secretary to the Board; .

4. The principal Act is amended by adding

immediately after section 9 the following section—

9A. (1) There shall be a secretary to the

Board. Board who shall be an officer of the Commis-

sioner designated by the Commissioner, but the office of secretary may be held by any officer of the Commissioner in conjunction with any other office to which he is appointed by the Commissioner.

(2) The secretary shall have such powers, duties and functions as are conferred on him by this Act or directed to be performed by him by the Board. .

Subsection (1) of section 11 of the principal Act is amended by adding after the word "supervision" in line one of paragraph (e) the passage "of the conduct and behaviour of operators of taxi-cars in relation to the provision of taxi-car services and".

Section 11A of the principal Act is amended by

adding after the word "or" in line six of subsection

(ha) the words "secretary or".

Section 23F of the principal Act is amended

(a)

as to subsection (1), by deleting the words "a summons in the prescribed form" in line two and substituting the words "notice in writing";

as to subsection (2), by deleting the word

"summoned" in line four and substituting

the words "required to attend"; and

(c) as to subsection (7)-

(i)    by deleting the word "summons" in line one and substituting the word "notice"; and

(ii)   by deleting the word "summoned" in line three of paragraph (a) and substituting the words "required to attend".

8. Section 26 of the principal Act is amended— ,re,a(Theci?

(a)

by deleting the passage "prescribing a requirement for the furnishing of statutory declarations." in lines three and four of subsection (la) and substituting the following paragraphs

(a)

prescribing a requirement for the furnishing of statutory declarations;

(b)

regulating the conduct and behavicur of operators in relation to the provision of taxi-car services;

(c)

relating to the type of vehicles that may be licensed as taxi-cars and the construction of and equipment, including internal fittings and decorations, required or permitted to be carried on vehicles that may be licensed as taxi-cars;

(d)

providing that no alterations or modifications to a vehicle licensed as a taxi-car shall be made without the approval of the Board;

(e)

as to the seating accommodation and the kind thereof to be provided in a taxi-car and specifying minimum requirements. ; and

(b)

by adding after subsection (la) the following subsection-

( lb) Any regulation made under this section may be made so as to require any matter affected by it to be subject to the approval of or to be done to the satisfaction of, the Board and may confer on the Board a discretionary authority. .
