Taxi and Private Hire Car Regulations Regulations2 (Amendment)

I, GORDON GLEN DENTON SCHOLES, the Minister of State for Territories, hereby make the following Regulations under the Motor Traffic Ordinance 1936.

Principal Regulations

1.  In these Regulations, “Principal Regulations” means the Taxi and Private Hire Car Regulations.

Taximeter to be set in motion when taxi hired

2.  Regulation 14 of the Principal Regulations is amended—

(a)by omitting from sub-regulation (1) all the words from and including “Except” to and including “sub-regulation 24 (5) —” and substituting “The driver of a taxi to which a taximeter is affixed —”; and

(b)by omitting from paragraph (1) (a) “or, where more than 1 kilometre rate will apply to that journey, for the initial part of that journey by that taxi”.

3.  Regulation 18 of the Principal Regulations is amended by omitting paragraph (1) (c) and substituting the following paragraph:

“(c)the taximeter is so adjusted that it is capable of registering—

(i)each of the kilometre rates;

(ii)each of the flag fall and hiring charges; and

(iii)the fee for waiting time,

prescribed by regulation 24, that may be charged in respect of a journey by that taxi.”.

4.  Regulation 19 of the Principal Regulations is amended—

(a)by omitting from sub-regulation (1) “, other than a journey of a kind referred to in sub-regulation 24 (4) where the distance to be travelled outside the City Area exceeds 10 kilometres or a journey of a kind referred to in sub-regulation 24 (5),”;

(b)by omitting from sub-regulation (1) “paragraph 24 (3) (b)” and substituting “sub-regulation 24 (4)”; and

(c)by omitting sub-regulation (3).

5.  Regulation 19A of the Principal Regulations is amended—

(a)by omitting from paragraph (1) (b) “paragraph 24 (3) (b)” and substituting “sub-regulation 24 (4)”;

(b)by omitting from sub-regulation (1A) “paragraph 24 (3) (a), (3A) (a) or (3A) (b)” and substituting “sub-regulation 24 (4) or (5)”; and

(c)by omitting from sub-regulation (1A) all the words after “that taxi,” and substituting “shall be the kilometre rate specified in sub-regulation 24 (4)”.

Repeal of regulation 19B

6.  Regulation 19B of the Principal Regulations is repealed.

7.  Regulation 24 of the Principal Regulations is amended—

(a)by omitting from sub-regulation (1) “where the taxi is not required to travel outside the City Area”;

(b)by omitting sub-regulations (2), (3), (3A), (4), (4A) and (5) and substituting the followng sub-regulations:

“(2)  Where on a journey a taxi is not the subject of a multiple hiring, the flag fall or hiring charge is—

(a)where the journey commenced between 10 a.m. and 3 p.m., Monday to Friday—$1.50;

(b)where the journey commenced—

(i)between 6 a.m. and 10 a.m., or between 3 p.m. and 12 midnight, Monday to Friday; or

(ii)between 6 a.m. and 12 midnight on a Saturday, Sunday or a day that is observed as a public holiday in the Territory in accordance with the Holidays Ordinance 1958,

$2; or

(c)where the journey commenced between 12 midnight and 6 a.m. on any day—$3.

“(3)  Where on a journey a taxi is the subject of a multiple hiring, the flag fall or hiring charge is $2.

“(4)  Where on a journey a taxi is not the subject of a multiple hiring, the kilometre rate for the journey is a rate of 60 cents for each kilometre, excluding the first kilometre, travelled by the taxi on the journey.

“(5)  Where on a journey a taxi is the subject of a multiple hiring, the kilometre rate for the journey is a rate of 45 cents for each kilometre, excluding the first kilometre, travelled by the taxi on the journey.”;

(c)by omitting from sub-regulation (6) all the words after “calculated” and substituting “at the rate of 25 cents for each minute that the taxi is required to wait”;

(d)by omitting sub-regulation (9); and

(e)by omitting from sub-regulation (10) “30” and substituting “50”.

8.  Regulation 26 of the Principal Regulations is amended by omitting sub-regulation (2).

9.  Regulation 27 of the Principal Regulations is amended by omitting “Where the hiring is for a journey inside the City Area, the” and substituting “The”.

10.  Regulation 28 of the Principal Regulations is amended—

(a)by omitting from paragraph (1) (b) “(not being a journey outside the City Area)”;

(b)by omitting from paragraph (1) (b) “or, where more than 1 kilometre rate will apply to that journey, for the initial part of that journey by that taxi and” and substituting “, and”; and

(c)by omitting from paragraph (1) (c) “or the hiring is for a journey outside the City Area,”.

Schedule 2

11.  Schedule 2 to the Principal Regulations is repealed and the following Schedule substituted:
