GLEESON CJ:   In this matter, the applicant has made written submissions in support of the application.  The Court has considered those submissions.  The application is an application for special leave to appeal against the judgment of Justice McHugh given on 8 September 1998.  The Court considers that the judgment of Justice McHugh was correct.  For that reason, the application is dismissed.
