i J by and with the advice and consent of the Legis­ lative Council and Legislative Assembly of ISfew South Wales in Parliament assembled, and by the authority of the same, as follows :—

1 . (1) This Act may be cited as the “ Taree-Wingham siioittuio

Water Supply Administration (Amendment) Act, 1954.”

W H E E E A S on the ten th day of October One thousand nine hundred and tw enty-eight an agreem ent was entered in to by the M inister and the Councils of the M unicipalities of Taree and W ingham w ith regard to the m anagem ent operation m aintenance repair and renewal of certain works of w ater supply for the towns of Taree and W ingham and the paym ent of the cost of the said works and of the renewal thereof and which A greem ent is hereinafter referred to as “the P rincijial A greem ent” AND W H E R E A S the M inister and the said Councils have agreed to vary and augm ent the provisions of the P rincipal Agreem ent N O W TT IS H E R E B Y

F U R T H E R A G R EED as follows:—

1. This Agreem ent shall be subject to ratification by Parliam ent

and upon such ratification shall operate as from the date hereof.

2. The P rinc ipa l Agreem ent shall be read and construed as if the am endm ents made herein by th is A greem ent were incorporated therein.

3.  The Principal Agreement is amended (1) By inserting afte r the words “the works” where appearing

in the recitals the w<jrds “ W hich expression shall for the purposes of clauses 5 and 8 hereof be deemed to include the works referred to in clause 4a hereof.”

(2) By inserting afte r clause 4 the following new clause

4a (1) The B oard of M anagem ent referred to in Clause 6 hereof may with the consent of the i l in is te r instal electrically driven pum ping plant and the Council of the M unicipality of Taree and the Council of the M unicipality of W ingham shall pay to the said Board the capital cost of such works in the proportion of seventy-four one hundredths and twenty-six one hundredths respectively.

(2) The said Board may from tim e to tim e with the consent of the M inister construct additional w ater su))ply works for the towns of Taree and W ingham and the said Couneils shall pay to the Board the capital cost of such works in the proportion respectively th a t the j)opulation of each M unicipality a t the date of completion of the additional works as estim ated by the Commonwealth S tatistic ian hears to the to ta l population of both M unicipalities as so disclosed.
